What does it do?

  • The Constitution of Nepal is the country's fundamental law. Any law that conflicts with it is void to the extent of the conflict. It was published in the Nepal Gazette on 20 September 2015 (2072-06-03 BS). It has a Preamble, 35 Parts containing 308 Articles, and 9 Schedules. The Schedules set out the national flag, the national anthem, the coat of arms, the districts in each Province, and five lists that divide powers between the levels of government. Laws that were in force when the Constitution began stay in force until they are repealed or amended. Nepal Law Commission · Nepal Law Commission Art. 1(1); Parts 1-35 (Arts. 1-308); Schedules 1-9; Art. 304(1). • Sovereignty and state power belong to the Nepali people. The Constitution describes Nepal as an independent, indivisible, sovereign, secular, inclusive, democratic, socialism-oriented, federal democratic republican state. The system of government is parliamentary. The President is head of state. Executive power lies with the Council of Ministers, led by a Prime Minister who must command a majority in the House of Representatives. The Federal Parliament has two Houses. The House of Representatives has 275 members: 165 elected first-past-the-post and 110 by proportional representation. Its term is five years. The National Assembly has 59 members and is a permanent House. Nepal Law Commission · Nepal Law Commission Arts. 2, 4(1), 61(2), 74, 75(1), 76(1)-(2), 83, 84(1), 85(1), 86(1)-(2). • Part 3 sets out the fundamental rights (Articles 16-46). There are also rights for women, children, Dalits and senior citizens, and a right to social justice. Article 48 lists citizens' duties. • The State has three levels: the Federation, the Provinces and the Local Levels. Each exercises state power under the Constitution and the law. Seven Provinces are formed from the districts listed in Schedule-4. The Local Levels are rural municipalities, municipalities and district assemblies. Powers are divided by lists: federal (Schedule-5), provincial (Schedule-6), shared between the Federation and Provinces (Schedule-7), local (Schedule-8), and shared by all three levels (Schedule-9). Each level may levy taxes within its own powers. The fiscal transfers that Provinces and Local Levels receive are to be as recommended by the National Natural Resources and Fiscal Commission. Nepal Law Commission · Nepal Law Commission Part 5, Arts. 56(1)-(4), 57(1)-(5), 60(1)-(4); Schedules 4-9. • Justice is administered by the courts: the Supreme Court, High Courts and District Courts. The Supreme Court is a court of record and has final authority to interpret the Constitution and the laws. Any citizen may ask it to declare void a law that conflicts with the Constitution. Parts 21-27 create constitutional bodies: the Commission for the Investigation of Abuse of Authority, the Auditor General, the Public Service Commission, the Election Commission, the National Human Rights Commission, and the National Natural Resources and Fiscal Commission. There are also seven further commissions: Women, Dalit, Inclusion, Indigenous Nationalities, Madhesi, Tharu and Muslim. Their office-holders are appointed by the President on the recommendation of the Constitutional Council, which the Prime Minister chairs, after a parliamentary hearing. Parliament is to review the seven commissions in Part 27 ten years after the Constitution began. Nepal Law Commission · Nepal Law Commission Arts. 126-128, 133(1), 153(1); Parts 21-27 (Arts. 238-265, incl. • Any Article can be amended except in a way that harms Nepal's sovereignty, territorial integrity, independence or the sovereignty of the people, and that limit itself cannot be amended. An amendment bill can start in either House and must be published within 30 days. If it changes a Province's borders or the provincial powers in Schedule-6, the Provincial Assemblies concerned have three months to approve or reject it. The bill fails if a majority of them reject it. It must then pass by 'at least two-thirds majority of the total number of the then members of both Houses', and the President authenticates it within 15 days. Both official texts list two amendments so far. The First Amendment, authenticated on 28 February 2016 (2072-11-16 BS), changed Articles 42, 84 and 286. The Second Amendment, authenticated on 18 June 2020 (2077-03-04 BS), changed Schedule-3, the coat of arms. Nepal Law Commission · Nepal Law Commission Part 31, Art. 274(1)-(10): English translation PDF pp.162-163, Nepali text PDF p.148. Gaps, loopholes and improvement ideas

  • Not enforced The National Dalit Commission reports that the laws needed to implement Article 40 (rights of Dalits) had still not been drafted. It also lists as a challenge that the staff posts and other resources needed to set up provincial offices under Article 257 have not been provided. The same report notes that a Dalit development bill was being prepared. National Dalit Commission · Nepal Law Commission NDC Fifth Annual Report, ch.6, s.6.1, 'Opportunities' item 1 and 'Challenges' item 1, printed p.81 (PDF p.92); Constitution Arts. 40, 47 and 257, English translation PDF pp.18-20, 150
  • Not enforced Article 285 says the federal civil service is to be formed and run under a Federal Act. In its 66th Annual Report, the Public Service Commission states that this Federal Civil Service Act had still not been enacted after a long time. It adds that without the Act, career development and job security remain unclear for staff who were adjusted to the federal, provincial and local levels. Some Provinces have passed their own civil service Acts. Public Service Commission · Nepal Law Commission PSC 66th Annual Report, ch.13 'Suggestions', para (1), printed p.108 (PDF p.135); Constitution Art. 285(1), English translation PDF pp.166-167
  • Outdated The National Human Rights Commission Act 2068 was made under the Interim Constitution of 2063. The Commission says it still has not been amended or replaced to fit the federal structure, long after the 2015 Constitution. It sent a draft National Human Rights Commission Act 2081 to the Office of the Prime Minister on 2081 Bhadra 17. The Commission says the Government agreed in principle to a new Act, but the bill has not been formally taken forward. It also notes that Nepal has no law on human rights defenders. National Human Rights Commission, Nepal · Nepal Law Commission NHRC 25th Annual Report FY 2081/82, ch.3, PDF p.38 (printed p.27); s.6.3.3, PDF p.146 (printed p.135); s.6.2 (challenges), PDF p.153 (printed p.142). • Not enforced Article 60(3) says the fiscal transfers that Provinces and Local Levels receive are to be as the National Natural Resources and Fiscal Commission recommends. In its Eighth Annual Report, the Commission repeats its suggestion that the NNRFC Act 2074 and the Intergovernmental Fiscal Management Act 2074 be amended so that this provision is put into effect. The report records the suggestion as not yet implemented. National Natural Resources and Fiscal Commission · Nepal Law Commission NNRFC Eighth Annual Report 2083, s.5.1.4, table item 1, printed p.128 (PDF p.156); Constitution Art. 60(3), English translation PDF p.36

Ideas to fix it

  • Draft and pass the laws needed to implement Article 40 on the rights of Dalits, and provide staff and resources for provincial offices under Article 257. The National Dalit Commission lists both as unmet needs. Proposed by: National Dalit Commission National Dalit Commission
  • Enact the Federal Civil Service Act under Article 285 without delay, so that the career development and job security of staff at all three levels are clear. Proposed by: Public Service Commission Public Service Commission
  • Replace the National Human Rights Commission Act 2068 with a new Act that fits the 2015 Constitution and the federal structure.
