What does it do?
- The Act aims to keep infectious animal diseases out of and from spreading within Nepal. The Government sets up animal quarantine checkposts and quarantine stations and appoints quarantine officers; animals, animal products and animal-production materials may be imported only through quarantine checkposts, with health certificates, and must meet conditions for import and export. The Government may ban imports from disease-affected areas, and quarantine officers may stop entry, order treatment, auction, removal or destruction of animals or products. Nepal Law Commission Sections 3–14, pp. 3–6
- When an infectious disease is found in one area, the office chief or quarantine officer may ban moving animals to other parts of Nepal, and office chiefs must carry out disease surveillance and control. To save local breeds from extinction or improve them, the Government may require castration of all males except the specified breed in an area (with an exception for animals kept for traditional religious rites, which must be kept apart). Nepal Law Commission Sections 15–16, 28, pp. 6–7, 9–10
- Industries producing biological products (such as vaccines), animal feed and similar goods need a recommendation to set up, imports and exports of such products need a recommendation, and selling biological products, chicks or fish fry or processing meat requires a licence and must meet quality standards. The Government appoints veterinary inspectors and may form a committee to prevent cruelty to animals. Importing without passing quarantine carries fines of up to Rs 25,000 (doubled if the goods are diseased), other breaches up to Rs 10,000 or Rs 5,000; quarantine officers investigate, and the Government is the plaintiff. Nepal Law Commission Sections 17–27, pp. 7–9
