What does it do?

  • The Act creates the Nepal Telecommunications Authority (NTA), an autonomous body, to regulate telecommunications. It has a chair and four members qualified in technical, administrative, market, accounting or legal fields, appointed by the Government on the recommendation of an expert selection committee. The NTA advises the Government on telecom policy, works to make services affordable and reliable, extends basic services to urban and rural areas, brings in domestic and foreign private investment, promotes fair competition, sets quality and service standards, approves and regulates service charges, issues directives, settles disputes between licensees and inspects operators. Nepal Law Commission Sections 3–5, 13–17, pp. 4–9
  • No one may run a telecom service without an NTA licence. Licences are issued after a public call for applications, are valid for a set period and renewable, cannot be sold or transferred without approval, and can be cancelled for breaches. Licensees must invest a prescribed share of their investment in rural areas, allow interconnection with other networks, pay royalties to the Government, provide service without discrimination and charge only NTA-approved tariffs. The Government may itself operate services and, in emergencies, take over or suspend services. Nepal Law Commission Sections 18–32, 41–42, pp. 10–17, 21
  • Where foreign investors hold more than 50 percent of a service provider, its land, buildings, equipment and structures pass to Government ownership when the licence ends (the former licensee may buy them back at an assessed value). Licensees may lay lines across land with compensation to owners. The NTA keeps its own fund and accounts, is audited, and must publish an annual report. Nepal Law Commission Sections 33, 36–40, 44–46, 55, pp. 17–23, 27
  • The NTA may fine anyone who breaches the Act, rules or its orders up to Rs 50,000 and order compensation; operating without a licence or breaching licence conditions carries fines up to Rs 500,000 and closure, and misuse or unauthorised use of services or damage to telecom property is penalised by recovering the loss plus a fine. Appeals against NTA decisions go to the High Court. Nepal Law Commission Sections 47–48, pp. 24–25

Gaps, loopholes and improvement ideas

  • Capacity The Rural Telecommunications Development Fund, financed by a 2 percent levy on licensees' annual telecom income, held Rs 15.71 billion (Rs 6.08 billion in fixed deposits and Rs 10.08 billion in cash and equivalents) at the end of FY 2081/82. The Auditor General said the NTA should adopt a suitable policy for using this money. Office of the Auditor General, Nepal OAG 63rd report, Nepal Telecommunications Authority, para 30, PDF p. 554 (printed p. 522)
  • Not enforced Of 261 licensed service providers, 40 had not paid the 2 percent rural telecom levy (Rs 162.1 million on FY 2080/81 income of Rs 8.11 billion) or the related penalties. The Auditor General also found that one internet service provider had paid the 4 percent royalty and 2 percent rural levy on only part of its income, contrary to the law. Office of the Auditor General, Nepal · Nepal Law Commission OAG 63rd report, NTA para 31, PDF p. 554 (printed p. 522); Inland Revenue chapter para 84, PDF p. 169 (printed p. 137); Act Section 32, p. 17
  • Unclear Section 13(i) and Section 42 require the NTA to approve and regulate the service charges licensees collect, but the Auditor General found that the tariffs the NTA approved did not separate the maintenance charge from the internet charge within bandwidth packages, and recommended making this clear in law and monitoring whether providers sell packages different from those approved. Office of the Auditor General, Nepal · Nepal Law Commission OAG 63rd report, NTA para 32, PDF p. 554 (printed p. 522); Act Sections 13, 42, pp. 7–8, 21

Ideas to fix it

  • The Auditor General recommended that the NTA adopt a policy for using the Rural Telecommunications Development Fund, recover unpaid levies and penalties, set clear tariff rules for bandwidth packages, and get the Information Highway (fibre) contracts financed from the Fund completed as agreed. Proposed by: Office of the Auditor General Office of the Auditor General, Nepal
