Enforced Disappearances Enquiry, Truth and Reconciliation Fund Operation Regulation, 2082

What does it do?

• This regulation runs the fund set up under Section 23A of the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act, 2071. The fund's money is used to give victims interim relief, relief and compensation under Sections 23 and 23A(4) of the Act, and may not be used for any other purpose. • The commission recommends to the Ministry the interim relief, relief and compensation to be given to a victim. The Ministry must then send the money through the District Administration Office of the district where the victim permanently lives. That office must confirm the victim's identity with the local level, pay the money by electronic fund transfer into a bank account in the victim's own name, and inform the Ministry, which must keep a record of the payments.आयोगले पीडितलाई दिने अन्तरिम राहत, राहत तथा क्षतिपूर्ति रकम उपलब्ध गराउन मन्त्रालयमा सिफारिस गर्छ। त्यसपछि मन्त्रालयले पीडितको स्थायी बसोबास भएको जिल्लाको जिल्ला प्रशासन कार्यालयमार्फत रकम उपलब्ध गराउनुपर्छ। जिल्ला प्रशासन कार्यालयले स्थानीय तहसँगको समन्वयमा पीडितको यकिन गरी निजको नाउँमा रहेको बैङ्क खातामा विद्युतीय रकमान्तरमार्फत रकम दिनुपर्छ र मन्त्रालयलाई जानकारी दिनुपर्छ; मन्त्रालयले दिइएको रकमको अभिलेख राख्नुपर्छ। Department of Printing, Government of Nepal Rules 4 and 5(1)-(3), PDF p. 3
• A fund steering committee gives policy guidance. It is chaired by the Minister for Law, Justice and Parliamentary Affairs, with the Secretaries of the Ministry, the Ministry of Finance and the Ministry of Home Affairs, one expert (for example a human rights defender, psychologist, lawyer, forensic expert or peace-process figure) and two victims, at least one a woman, both nominated by the Ministry. Nominated members serve two years and may be removed early for listed reasons after a fair chance to respond. • The committee coordinates the commissions on use of the fund and on setting limits for relief and compensation amounts, and must make sure the money is used fairly and transparently. Fund money is kept in an account at a class 'A' commercial bank chosen by the committee, operated by joint signature of two Ministry finance officials. Internal audit is done by the Treasury and Accounts Controller Office and the final audit by the Auditor General. • The committee must publish on the websites of the Ministry and the commission the technical and financial help received from foreign governments, development partners and international organisations, what the fund has spent, and its current balance. Its secretariat, in the Ministry, must keep up-to-date records of spending and of money released to victims.
