Mutual Legal Assistance Regulation, 2079

What does it do?

• When a Nepali investigating officer needs help from a foreign state in an investigation or prosecution, they must send a request to the Central Authority on the Schedule 1 form. A court that orders such help uses the Schedule 2 form. The Central Authority then sends the request to the foreign state through diplomatic channels on the Schedule 3 form, or in the format that state requires.कसूरको अनुसन्धान वा अभियोजनमा विदेशी राज्यको सहायता चाहिए अनुसन्धान अधिकारीले अनुसूची–१ को ढाँचामा केन्द्रीय अधिकारीसमक्ष अनुरोध गर्नुपर्छ। यस्तो सहायता माग्ने आदेश दिने अदालतले अनुसूची–२ को ढाँचा प्रयोग गर्छ। त्यसपछि केन्द्रीय अधिकारीले अनुसूची–३ को ढाँचामा, वा विदेशी राज्यले फरक ढाँचा अपनाएको भए सोही ढाँचामा, कूटनीतिक माध्यममार्फत अनुरोध पठाउनुपर्छ। Nepal Law Commission Rule 3(1)-(4), PDF pp. 1-2
• If a state with no bilateral treaty with Nepal asks for help, the Ministry of Foreign Affairs must study the request within 15 days. It recommends help on the basis of reciprocity only if that state has promised, through diplomatic channels, to help Nepal in similar cases and the help would not harm Nepal's sovereignty or public order. Requests must use the Schedule 4 form, but one that has the needed details and documents is not refused only because of the form. • If a fee applies to help given to a foreign state, the Central Authority tells that state, taking reciprocity into account. If payment is late, the Central Authority must pay it and go ahead at once; the foreign state later repays into a bank account the Central Authority names. • A coordination committee chaired by a joint secretary of the Ministry of Law, Justice and Parliamentary Affairs advises the Central Authority on requests in both directions. The Central Authority must keep a roster of translators for different languages, updated each fiscal year, and a single central record of all requests sent and received. It must submit its annual report to the Council of Ministers within three months after each fiscal year ends. This regulation replaced the Mutual Legal Assistance Regulation, 2070.कानून, न्याय तथा संसदीय मामिला मन्त्रालयका सहसचिवको संयोजकत्वमा रहने समन्वय समितिले आउने र जाने दुवै किसिमका अनुरोधमा केन्द्रीय अधिकारीलाई सिफारिस र सहयोग गर्छ। केन्द्रीय अधिकारीले विभिन्न भाषाका अनुवादकको रोष्टर प्रत्येक आर्थिक वर्ष अद्यावधिक गर्नुपर्छ र पठाइएका तथा प्राप्त सबै अनुरोधको एकीकृत केन्द्रीय अभिलेख राख्नुपर्छ। प्रत्येक आर्थिक वर्ष सकिएको तीन महिनाभित्र वार्षिक प्रतिवेदन मन्त्रिपरिषद्मा पेस गर्नुपर्छ। यस नियमावलीले पारस्परिक कानूनी सहायता नियमावली, २०७० खारेज गरेको छ। Nepal Law Commission Rules 7, 8, 9(2), 11, 12 and 13, PDF pp. 4-6
