What does it do?

  • The Act lets Nepal exchange mutual legal assistance with foreign states in civil and criminal proceedings where there is a bilateral treaty, or, without a treaty, where the foreign state gives an assurance of reciprocity for similar proceedings in future. Assistance is not given in civil matters worth less than Rs 100,000 or for offences punishable by less than one year's imprisonment or a fine under Rs 50,000, among other exclusions. The Government designates a Central Authority by Gazette notice to handle requests. Nepal Law Commission Sections 3–6, pp. 3–5
  • Nepali courts and agencies, through the Central Authority, may ask foreign states to provide evidence, produce or locate persons, serve summons and judicial documents, take witness testimony, freeze or confiscate property, and enforce Nepali judgments; requests must contain prescribed details and documents, and evidence obtained can be used in Nepali proceedings. Nepal Law Commission Sections 7–18, pp. 5–15
  • Foreign states may ask Nepal for the same kinds of help. The Central Authority studies each request, may refuse it in the cases the Act lists (including where no treaty request is made or the conditions in Section 4 apply), and otherwise applies to the court; the court can order evidence to be provided, persons produced, documents served, witnesses examined, property frozen or confiscated, and foreign judgments enforced, subject to special conditions. Documents must be authenticated, the Central Authority must report on its work, and the Government makes implementing rules. Nepal Law Commission Sections 19–45, pp. 15–29
