What does it do?

Offices must make their payments and close accounts at least seven days before the fiscal year ends; apart from account adjustments, no payment is released on the last day of the year (Rule 30). Ministry of Law, Justice and Parliamentary Affairs Rules 29–30, PDF pp. 16–17
  • Secretaries may move money between budget heads (virement) within the limits of the Act, but not before the first four-month period of the year ends and not to a spending head with no appropriation; each virement must be reported to the Auditor General, the Ministry of Finance and the Treasury and Accounts Office, and larger transfers need the Ministry of Finance's approval (Rule 32). Before spending, the authorised official must make sure the spending is within the amount approved by the Appropriation Act, is lawful and supported by evidence, and follows internal controls (Rule 41). Ministry of Law, Justice and Parliamentary Affairs Rules 32 and 41, PDF pp. 18–19, 23–24

  • Advances must be kept to what the task needs. The person who takes an advance must submit bills within 15 days of finishing the work (travel advances within 15 days of return; purchase advances within 21 days), and the office must settle it within 7 days. Overdue advances carry 10 per cent annual interest, can be recovered from the employee's salary, and the names of those who do not settle may be published; the office chief may extend the deadline by at most 15 days. Unsettled advances must be carried into the next year with full details of who took them and why (Rules 47–54). Ministry of Law, Justice and Parliamentary Affairs Rules 47–54, PDF pp. 28–30

Gaps, loopholes and improvement ideas

  • Not enforced The cash plan required by Rule 29 has not been prepared. The Auditor General found that the Ministry of Finance did not prepare a periodic cash plan in FY 2081/82. That year the government borrowed Rs 126.95 billion abroad and Rs 329.08 billion at home, while Rs 132.45 billion that it had transferred to provinces and local governments, partly from borrowed money, sat unspent in their accounts, so the government was paying interest on money that was not being used. Office of the Auditor General, Nepal OAG 63rd Annual Report, chapter 3 (summary of main findings), para 10, printed p. 17 (PDF p. 47); Ministry of Finance chapter, para 18, printed p. 105 (PDF p. 137)
  • Not enforced Budget limits in Rules 32 and 41 are not always respected. Rule 41 requires spending to stay within the amount approved by the Appropriation Act, yet under the financing heads for three projects and the Public Debt Management Office Rs 7.54 billion was spent against Rs 4.52 billion appropriated, Rs 3.02 billion more than approved; the Auditor General notes that the Treasury Single Account system did not stop releases above the budget. Rule 32(1) bars virement before the first four-month period ends, yet Rs 1.05 billion was moved or released through virement (including from the Finance miscellaneous head) during that period. Office of the Auditor General, Nepal OAG 63rd Annual Report, Ministry of Finance chapter, paras 23 and 24.2, printed pp. 107–108 (PDF pp. 139–140)
  • Not enforced Advances are not settled on time. Rules 47–54 set short deadlines for settling advances and charge interest on overdue ones. The government's consolidated financial statement for FY 2081/82 shows Rs 34.91 billion in advances outstanding (federal Rs 11.69 billion, provincial Rs 6.90 billion and local Rs 16.32 billion); of this, Rs 30.36 billion in budget bodies was past its deadline, and a further Rs 2.35 billion was overdue in non-budgetary bodies. Office of the Auditor General, Nepal OAG 63rd Annual Report, Ministry of Finance chapter, paras 55–55.1, printed pp. 123–124 (PDF pp. 155–156)
  • Not enforced Annual stock inspections under Rule 99 do not give a true picture of government property. The Auditor General found that government assets worth Rs 483.10 billion were reported without saying which items are in use or need repair, auction or write-off, so all assets appear as if in working order, and that assets not entered in the stock books were not disclosed. Citing the same rule, it also found that 221 local governments had not carried out stock inspections and 293 had not used the Public Assets Management System that the Financial Comptroller General Office had made mandatory. Office of the Auditor General, Nepal OAG 63rd Annual Report, Ministry of Finance chapter, para 60.3, printed pp. 126–127 (PDF pp. 158–159); chapter 3 (summary of main findings), para 102, printed p. 47 (PDF p. 77)

Ideas to fix it

  • Combine the stock inspection reports so that the consolidated statement shows each asset's physical condition and what has been written off, bring unrecorded assets into the stock books, and keep separate accounts for assets to be auctioned or repaired. Proposed by: Office of the Auditor General Office of the Auditor General, Nepal
  • Update the payment system so that money can be released only within the approved budget. Proposed by: Office of the Auditor General Office of the Auditor General, Nepal
