National Natural Resource and Finance Commission Regulation, 2076

What does it do?

• These rules were made by the Commission itself under Section 22 of its Act. They list the study work behind its recommendations: setting the basis and standards for fairly sharing benefits from natural resources, working out how much money is transferred to provinces and local levels, assessing their spending needs and revenue capacity, and preparing the basis and formula for dividing revenue from the federal Consolidated Fund. • The federal government, provinces and local levels must play a cooperative role with the Commission and must give it the information, financial details and data it asks for on time. The Commission may base its recommendations, reviews and advice on that information. • The Commission decides by majority at its meetings, with the chair holding a casting vote. A meeting needs more than half of the sitting members, but may still be held if only the chair has been appointed or is present. Members must get the agenda normally 48 hours ahead. It may form a coordination and facilitation committee, chaired by its own chair, with secretaries of key ministries, the National Planning Commission, the Financial Comptroller General and heads of departments such as mines, electricity and drinking water.आयोगको निर्णय बैठकमा बहुमतबाट हुन्छ र मत बराबर भए अध्यक्षता गर्नेले निर्णायक मत दिन्छ। तत्काल कायम सदस्यमध्ये पचास प्रतिशतभन्दा बढी उपस्थित भए गणपूरक सङ्ख्या पुग्छ, तर अध्यक्ष मात्र नियुक्त वा उपस्थित भए पनि बैठक बस्न सक्छ। सदस्यले विषयसूची साधारणतया अठचालीस घण्टाअगावै पाउनुपर्छ। आयोगले अध्यक्ष संयोजक रहने र प्रमुख मन्त्रालयका सचिव, राष्ट्रिय योजना आयोगका सचिव, महालेखा नियन्त्रक तथा खानी, विद्युत्, खानेपानीलगायत विभागका महानिर्देशक सदस्य रहने अन्तर-समन्वय एवं सहजीकरण समिति बनाउन सक्छ। Nepal Law Commission Rules 9(5)-(7) and 16(1)-(2), PDF pp. 4, 9
• A federal, provincial or local body that wants the Commission's advice must send a request, decided by an authorised official, with the details in Schedule 2: the problem, the legal provisions causing it and its own proposed solution. The Commission may then give advice. It may also take on experts or specialist bodies under contract, but must get the Ministry of Finance's agreement before fixing their pay.आयोगसँग सुझाव चाहने नेपाल सरकार, प्रदेश सरकार वा स्थानीय तहले अख्तियारप्राप्त अधिकारीबाट निर्णय गराई अनुसूची-२ बमोजिम समस्याको व्यहोरा, समस्या ल्याएका कानूनी प्रावधान र आफ्नो प्रस्तावित उपायसहित अनुरोध पठाउनुपर्छ। त्यसपछि आयोगले आवश्यक सुझाव दिन सक्छ। आयोगले करारमा विशेषज्ञ वा विशिष्टीकृत निकायको सेवा लिन सक्छ, तर पारिश्रमिक तोक्नुअघि अर्थ मन्त्रालयको सहमति लिनुपर्छ। Nepal Law Commission Rules 14(1)-(3) and 17(1)-(2), Schedule 2, PDF pp. 7, 10-11, 14
• Anyone concerned may apply for a copy of the Commission's decisions or documents. The fee is Rs 5 a page if the applicant makes the copy and Rs 10 a page if the Commission makes it; government offices pay nothing. Documents the Commission has decided must be kept secret are not provided. The Commission may publish its work through its spokesperson, information officer or website.सरोकारवालाले आयोगको निर्णय वा कागजातको प्रतिलिपि लिन निवेदन दिन सक्छ। आफैँ प्रतिलिपि सार्दा प्रतिपृष्ठ पाँच रुपैयाँ र आयोगले प्रतिलिपि बनाइदिँदा प्रतिपृष्ठ दश रुपैयाँ दस्तुर लाग्छ; सरकारी कार्यालयलाई दस्तुर लाग्दैन। आयोगले गोप्य राख्नुपर्ने भनी ठहर गरेका कागजातको प्रतिलिपि दिइँदैन। आयोगले प्रवक्ता, सूचना अधिकारी वा वेबसाइटमार्फत आफ्नो काम सार्वजनिक गर्न सक्छ। Nepal Law Commission Rules 20(1)-(2) and 22, PDF p. 12
