What does it do?

• An unemployed person who wants minimum employment must apply to their ward office in Falgun each year, on the Schedule-1 form, to be listed for the next fiscal year. After a disaster or other special situation the Ministry may call applications at another time, and a local level may, with Ministry approval, open a window of up to one month once a year. The ward office must send applications to the Employment Service Centre within seven days.न्यूनतम रोजगारमा संलग्न हुन चाहने बेरोजगार व्यक्तिले आगामी आर्थिक वर्षको सूचीमा सूचीकृत हुन प्रत्येक वर्षको फागुन महिनामा अनुसूची-१ को ढाँचामा सम्बन्धित वडा कार्यालयमा निवेदन दिनुपर्छ। विपद् वा अन्य विशेष परिस्थितिमा मन्त्रालयले अर्को अवधि तोकी निवेदन माग्न सक्छ र स्थानीय तहले मन्त्रालयको स्वीकृतिमा वर्षमा एक पटक बढीमा एक महिनाको अवधि तोकी निवेदन माग्न सक्छ। वडा कार्यालयले प्राप्त निवेदन सात दिनभित्र रोजगार सेवा केन्द्रमा पठाउनुपर्छ। Nepal Law Commission Rule 7(1)-(3), PDF pp. 4-5
• The rural or municipal executive must approve the final list of unemployed people. To qualify, a Nepali citizen must be at least 18 and not over 59, and must not have had at least 100 days of work in that fiscal year; a self-employed person qualifies if their income that year is below the minimum wage for 100 days. The Employment Service Centre must rank the list by priority within 30 days and enter it in the employment management system. If it is disputed whether someone is unemployed, the chair or mayor decides on the ward office's recommendation.गाउँ कार्यपालिका वा नगर कार्यपालिकाले बेरोजगार व्यक्तिको अन्तिम सूची स्वीकृत गर्नुपर्छ। बेरोजगार ठहरिन नेपाली नागरिक कम्तीमा अठार वर्ष पूरा भई उनान्साठी वर्ष ननाघेको र सोही आर्थिक वर्षमा कम्तीमा एक सय दिन रोजगारमा संलग्न नभएको हुनुपर्छ; स्वरोजगार व्यक्तिको हकमा सो वर्षको आय एक सय दिनको न्यूनतम पारिश्रमिकभन्दा कम हुनुपर्छ। रोजगार सेवा केन्द्रले तीस दिनभित्र प्राथमिकताक्रम निर्धारण गरी रोजगार व्यवस्थापन प्रणालीमा प्रविष्ट गर्नुपर्छ। कोही बेरोजगार हो वा होइन भन्ने प्रश्न उठे वडा कार्यालयको सिफारिसमा अध्यक्ष वा प्रमुखले निर्णय गर्छन्। Nepal Law Commission Rules 4 and 7(4)-(6), PDF pp. 2, 5-6
• Each local level's Employment Service Centre is run by an employment coordinator of at least the fifth level of local service. It keeps the list of unemployed people, issues them identity cards, publicises job openings, recommends skills training and reports monthly to the federal and provincial ministries. An employer needing workers applies to the Centre on the Schedule-3 form, and if suitable workers are listed the Centre must recommend them within seven days. • A person entitled to the subsistence allowance applies to the Employment Service Centre with a self-declaration on the Schedule-5 form and a ward office recommendation that the family qualifies. An official who gives a false recommendation faces action under the law. The allowance is paid into the person's bank account, and the local level must arrange zero-balance accounts. It must be paid within three months after each fiscal year ends, and the next year's budget must provide for it based on the number of people listed in the employment management information system.निर्वाह भत्ता पाउने बेरोजगार व्यक्तिले अनुसूची-५ को ढाँचामा स्वघोषणा गरी परिवार निर्वाह भत्ता पाउन योग्य रहेको वडा कार्यालयको सिफारिससहित रोजगार सेवा केन्द्रमा निवेदन दिनुपर्छ। झुट्टा सिफारिस गर्ने अधिकारीउपर प्रचलित कानूनबमोजिम कारबाही हुन्छ। भत्ता सम्बन्धित व्यक्तिको बैङ्क खातामा जम्मा गरिन्छ र स्थानीय तहले शून्य मौज्दातमा खाता खोल्ने व्यवस्था मिलाउनुपर्छ। प्रत्येक आर्थिक वर्ष समाप्त भएको तीन महिनाभित्र भत्ता वितरण गर्नुपर्छ र रोजगार व्यवस्थापन सूचना प्रणालीमा सूचीकृत बेरोजगारको सङ्ख्याका आधारमा अर्को वर्षको बजेटमा व्यवस्था गर्नुपर्छ। Nepal Law Commission Rule 18(1)-(3), (6)-(7), (9)-(9ख), PDF pp. 10-11
• Anyone who knows that an offence under the Act has been or is about to be committed must file a written complaint with the Labour and Employment Office, either directly or through the Employment Service Centre; an oral complaint must be written down and signed by the complainant. The Office must decide the complaint within three months.
