What does it do?

  • Every citizen has the right to employment and to choose their work; no one may be forced into work against their will, and employers may not discriminate on grounds such as origin, religion, caste, sex, language, region or belief. People may not be dismissed without cause, and a person dismissed unlawfully can apply to the employment service centre, after which the local level may direct the employer to take them back. Nepal Law Commission, Government of Nepal Sections 3–7, pp. 2–3
  • The federal, provincial and local governments must run employment programmes to give unemployed people minimum employment, with priority to women, Dalits, the poor and families of martyrs and the disappeared. Each local level has an employment service centre that registers the unemployed, collects employers' details and labour demand, and shares job information; a steering committee coordinates policy and evaluates programmes. Nepal Law Commission, Government of Nepal Sections 8–19, pp. 3–7
  • Unemployment assistance includes job information, training, subsidised loans and self-employment support; people who refuse assigned work are removed from the list. If the government cannot give a registered unemployed person minimum employment, it must pay a subsistence allowance of 50% of the minimum wage for 100 days a year (or for the days short of 100), but only to households where no one has a job, self-employment or foreign employment and whose income is below a set level. Nepal Law Commission, Government of Nepal Sections 20–22, pp. 7–8

Gaps, loopholes and improvement ideas

  • Not enforced The minimum-employment guarantee reaches few of those registered. Under the Prime Minister Employment Programme, which runs the Act's employment service centres, Rs 6 billion was budgeted in FY 2081/82 to give about 200,000 people at least 100 days of work, but only 54,587 people got work, for an average of 53 days, at a cost of Rs 4.85 billion; this was out of 797,725 unemployed people registered. Employment service centres had not kept their data on domestic and foreign jobs up to date. Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 63rd Report, MoLESS chapter, para 10, printed pp. 466–467; Act ss. 8, 10 and 22, pp. 3–4, 8
