What does it do?

  • A writ petition under Article 133(2) of the Constitution may be filed by the person whose right is affected, or, on a public-interest question, by someone with a meaningful link and real interest in it. The fee is Rs 500; a habeas corpus petition is free and a relative may file it if the detainee cannot. The court may order the detainee produced, with a written reply, within at most three days plus travel time. Once told of the order, the detaining side may not move the detainee without the court's order. A false reply or moving the detainee leads to release. Nepal Law Commission Rules 32(1), 33(1), 34(1), 38 and 39, Schedule 3 item 1, PDF pp. 21-24, 104
  • A public-interest petition must show the constitutional or legal question, who is affected, and that the issue has not already been decided. It must also say whether the petitioner first asked the responsible government body for a remedy, or why that was not possible. The petitioner must declare no personal gain or private interest and cannot withdraw the petition once registered. The court may order an expert study, at the cost of the government or the body concerned. It may act against anyone who files for personal, political or financial gain or to harass others. Nepal Law Commission Rules 40(2)-(3), 51(2), 52 and 53, PDF pp. 24-25, 30-31
  • The court may issue an interim order where there would be irreparable harm, a serious breach of a fundamental right or the law, or where the balance of convenience requires it. It must give reasons whether it grants or refuses one. An interim order ends automatically when its set period runs out or the case is decided. A respondent who had no chance to be heard may apply to have it cancelled, and the court may cancel or change it. Nepal Law Commission Rules 49 and 50, PDF pp. 28-30
  • Writ petitions are normally listed for first hearing within three days of registration, and habeas corpus petitions within seven days of the written reply. The daily cause list gives priority to habeas corpus, cases involving children or persons with disabilities, parties over 75, violence against women, and women's maintenance, divorce, partition or domestic violence cases. A hearing can be postponed at most twice. Part-heard cases and cases where a party has more than one lawyer cannot be postponed at that party's request. Nepal Law Commission Rules 74(6)-(7), 76(5) and 77(5), (7), PDF pp. 43-49
  • A party may ask the court to review its own judgment on the grounds in the Administration of Justice Act, 2073; the fee is Rs 100 and the petition goes to justices other than those who decided the case. Parties may also ask at any time to settle a pending case through mediation, which may be given up to three months. The court keeps salaried legal aid lawyers, chosen by open competition, to draft documents and argue free of charge for people who cannot afford a lawyer, including the helpless, minors, the poor and people in detention. Nepal Law Commission Rules 63(1), (4), 78(1), (6) and 143-144, Schedule 3 item 4, PDF pp. 37, 49-50, 85-86, 104
