Special Economic Zone Regulation, 2074

What does it do?

• A private investor who wants to build and run a Special Economic Zone must apply to the Special Economic Zone Authority with details of the site, infrastructure, planned industries, proposed rent and service fee, security arrangements and investment. The Authority surveys the site at the applicant's cost and recommends to the Ministry. After government approval, the Authority issues an approval letter for a Rs 10,000 fee. The developer must charge industries rent and fees within the Authority's standards and provide adequate security.निजी क्षेत्रबाट विशेष आर्थिक क्षेत्र स्थापना र सञ्चालन गर्न चाहने लगानीकर्ताले स्थान, पूर्वाधार, सञ्चालन हुने उद्योग, प्रस्तावित भाडा र सेवा शुल्क, सुरक्षा व्यवस्था र लगानीको विवरणसहित विशेष आर्थिक क्षेत्र प्राधिकरणमा निवेदन दिनुपर्छ। प्राधिकरणले निवेदकको खर्चमा सर्वेक्षण गरी मन्त्रालयमा सिफारिस गर्छ। नेपाल सरकारको स्वीकृतिपछि प्राधिकरणले दश हजार रुपैयाँ दस्तुर लिई स्वीकृतिपत्र दिन्छ। स्वीकृतिपत्र प्राप्त व्यक्तिले उद्योगसँग लिने भाडा र शुल्क प्राधिकरणको मापदण्डअनुसार हुनुपर्छ र पर्याप्त सुरक्षा प्रबन्ध मिलाउनुपर्छ। Nepal Law Commission Rules 19-21, PDF pp. 16-18
• For zones built jointly by the government and private investors, the Authority must invite expressions of interest with at least 21 days' notice in national dailies in Nepali and English. Bidders are scored on technical capacity (40), financial capacity (40) and experience (20), and need 60 marks to be shortlisted. The project agreement lasts at most 30 years and may be extended by up to ten years. • Cigarettes, bidi, tobacco and similar products, alcoholic drinks, explosives, and arms and ammunition cannot be made in a zone. A domestic investor must put in fixed capital of at least Rs 2 crore. The Authority must issue an industry permit within seven days for a Rs 25,000 fee, or give written reasons within seven days. The permit holder must apply to register the industry within seven days. • Before selling goods or services in Nepal's domestic market, a zone industry must report to the Authority how much it produced, exported and plans to sell at home, why, and any concessions it received. • A zone industry must submit a training plan to make Nepali workers able to take over jobs done by foreigners, and report when they are replaced; an industry that employs foreigners in breach of the Act loses its facilities. A worker with a complaint about service terms may go in writing to the grievance committee, which must hold talks within seven days and, failing agreement, decide within 15 days.
