What does it do?
- When a local body orders waste to be sorted at source into at least organic and inorganic, it must also require harmful or chemical waste to be kept and handled separately. Households, organisations and offices must then sort their waste that way. The producer is responsible for managing its own sorted chemical or harmful waste. The local body must set the time, place and method for putting waste out, and run awareness programmes on sorting and reducing waste. Nepal Law Commission Rules 3(1)-(3) and 4(1)-(3), PDF pp. 1-2
- Harmful or chemical waste must not be mixed with other waste. Anyone who produces or handles it must get the local body's approval for the method, technology and site, keep records, and treat the waste until its harmful content is destroyed before final disposal. Health institutions must sort their own waste at source and treat it themselves with approved methods, or ask the local body to do it for a service fee. Sterilisation of infectious health-care waste must be tested and certified by a recognised laboratory. Nepal Law Commission Rules 5(1)-(9) and 6(1)-(6), PDF pp. 2-4
- A company or organisation wanting to manage waste must apply to the local body in the Schedule-1 form with the fee the local body sets, stating whether it will work commercially or on a non-profit community basis. If papers are missing, the local body must tell the applicant within seven days and give 15 days to supply them. It must issue a licence within 30 days or give reasons for refusal within seven days. A licence lasts five years; renewal must be sought six months before expiry and decided three months before. Nepal Law Commission Rules 10(1)-(2), 11(2)-(6) and 13(1)-(2), PDF pp. 6-7
- A local body may cancel a licence for breaking its conditions, not meeting standards, breaching environmental law or not renewing it. If a private operator of a waste site breaks the local body's standards, it is first given up to 90 days to fix the problem, extendable by up to 60 days; if it still fails, its approval may be cancelled. The operator must pay for any harm caused by its failure to work as approved. Nepal Law Commission Rules 12 and 15(2)-(3), PDF pp. 7-9
- Local bodies set waste service fees based on how much and what kind of waste a producer puts out, what the producer does to manage waste at source, the environmental impact and the cost. Poor households that cannot pay, as recommended by the ward office or village development committee, may get up to fifty percent off; the local body must publish its list of such households every year. Households that reduce waste at source may also get a discount. Nepal Law Commission Rules 16(1) and 17(1)-(3), PDF pp. 9-10
