What does it do?

  • A domestic violence complaint is made on the Schedule-1 form to a police office, the National Women Commission, a local body or a court. An oral complaint must be written down and signed or thumb-printed, and the complainant gets a receipt. If the same case is filed in a court and elsewhere, only the court acts; among other bodies, only the one the victim chooses acts; and the victim's own complaint takes precedence over anyone else's. Nepal Law Commission Rules 2(ग) and 3(1)-(6), PDF pp. 1-2
  • If a complaint mentions physical injury or mental torture, the body must at once send the victim to the nearest hospital or health centre, which must treat the victim and send back an examination report. If further harm is likely, the complainant may ask for protection; the nearest police office must then immediately arrange a safe place or a stay in a service centre and stop further harm. Nepal Law Commission Rules 6(1)-(2) and 7(1)-(3), PDF p. 3
  • If the accused does not appear when summoned, cannot be brought in, or mediation between victim and accused fails, the local body or police office must send the complaint file to the court within the time limit in Section 4(11) of the Act, using the Schedule-4 letter. The court then deals with the case and informs the office that sent it. Nepal Law Commission Rule 8(1)-(2), PDF pp. 3-4
  • An organisation wanting to run a service centre for victims must apply to the Ministry on the Schedule-5 form. The Ministry approves it if the centre has basic premises, minimum health care and security, counselling, psychological and legal help, and the capacity to give victims financial help. The Ministry inspects centres, may give directions, and may cancel approval if they are not followed, after giving the centre a chance to defend itself. Nepal Law Commission Rules 9(1)-(2), 10 and 11(1)-(5), PDF pp. 4-5
  • Each Women Development Office is to have a women protection officer who acts as the district contact point and gives victims legal help and counselling. A committee chaired by the ministry Secretary runs the service fund, a revolving fund that pays for service centres, victims' safety and treatment, legal aid and awareness work. Administrative costs may not exceed ten percent of the fund's budget, and the Auditor General audits it. Nepal Law Commission Rules 12(1)-(3), 13(1)-(2), (4), 14(1)-(2), 15 and 16(2), PDF pp. 5-7
