What does it do?
- Public bodies must plan their purchases. A master procurement plan is required for projects lasting more than a year or for purchases of more than Rs 100 million a year, approved at a level that rises with the amount (from a second-class gazetted office chief up to Rs 250 million, to the ministry secretary above Rs 1 billion) and updated every year (Rule 7). Any body buying more than Rs 1 million a year must prepare an annual procurement plan with its budget, setting out packages, methods and timetables (Rule 8). Ministry of Law, Justice and Parliamentary Affairs Rules 7–8, PDF pp. 7–8
- Goods, works or services estimated at up to Rs 2 million may be bought through sealed quotations (up to Rs 5 million for X-ray, ECG, medicines and medical equipment), if fewer than three quotations come in after the first notice, a second notice is published, and the lowest quotation is chosen from the first call only if at least three are substantially responsive (Rule 84). Direct purchase is allowed up to Rs 1.5 million for works or goods and up to Rs 500,000 for consulting or other services, and no body may buy more than these limits from the same supplier in one year, whether at once or in several lots (Rule 85). Ministry of Law, Justice and Parliamentary Affairs Rules 84–85, PDF pp. 84–88
- Works or related services estimated at up to Rs 10 million may be given to a registered users' committee made up of local residents who will use the service (Rule 97). The public body must deduct VAT, overhead, contingency and the users' agreed contribution before paying; it may advance up to one-third of the contract amount; heavy machinery may not be used unless the cost estimate requires it and the body approves; and the committee must do the work itself, not through a contractor or subcontractor. A committee found using a contractor has its agreement cancelled, and the contractor is recommended for blacklisting. Ministry of Law, Justice and Parliamentary Affairs Rule 97, PDF pp. 103–106
- If a contractor, supplier or consultant is late through its own fault, the contract may require liquidated damages of normally 0.05 per cent of the contract price per day, up to 10 per cent, and the contract must be ended if the work is still unfinished after that maximum period (Rule 121). Running bills must be approved and paid within 30 days, with 5 per cent kept back as retention money (Rule 123). Ministry of Law, Justice and Parliamentary Affairs Rules 121 and 123, PDF pp. 128–129
- Besides its duties under Section 65 of the Act, the Public Procurement Monitoring Office monitors public bodies' procurement, sets up a central data bank of contract performance, plans for and checks the qualifications of procurement staff and evaluation committee members, monitors implementation of review committee decisions and reports to the Office of the Prime Minister and Council of Ministers, and runs training for procurement staff (Rule 144). Ministry of Law, Justice and Parliamentary Affairs Rule 144, PDF pp. 139–140
Gaps, loopholes and improvement ideas
- Not enforced Liquidated damages under Rule 121 often go uncollected. Rule 121 and the contracts provide for liquidated damages of 0.05 per cent of the contract price per day, up to 10 per cent, when contractors finish late through their own fault. The Auditor General found that bodies under the ministries of Physical Infrastructure and Transport; Energy, Water Resources and Irrigation; Education, Science and Technology; and Defence had not collected Rs 2.08 billion of such damages (62nd report), and that bodies under the ministries of Physical Infrastructure and Transport, Drinking Water, Urban Development and Defence had not collected Rs 199.80 million on 19 contracts (63rd report). Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 62nd Annual Report, chapter 3 (summary of main findings), para 72, printed p. 39 (PDF p. 67); OAG 63rd Annual Report, chapter 3, para 44, printed p. 30 (PDF p. 60)
- Not enforced Rule 97 is often breached when local governments use users' committees. The rule is meant for labour-based work done by the committee itself, with the users' contribution deducted before payment and no contractors. In FY 2081/82 the Auditor General found that 265 local governments had given 1,636 technically complex works worth Rs 2.69 billion to users' committees; 85 had paid Rs 60.69 million on 690 projects without deducting the users' share; and 143 had paid Rs 710.81 million for 1,014 projects whose work was actually done by contractors (the year before, 118 local governments paid Rs 898.36 million for 1,791 such projects). The High-Level Economic Reform Suggestion Commission, citing the Public Procurement Monitoring Office, also lists users' committees having contractors do their work among the irregularities in the construction sector. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 63rd Annual Report, local government section, paras 35–37, printed pp. 919–920 (PDF pp. 973–974); OAG 62nd Annual Report, section 4 (local governments), para 45, printed p. 888 (PDF p. 928); HLERC report, public procurement section, para 22, printed p. 248 (PDF p. 315)
- Capacity The Public Procurement Monitoring Office has not carried out several duties under Rule 144 and lacks capacity. The Auditor General found that it had not certified procurement experts, set up a central data bank recording contract performance, or drafted a procurement code of conduct. The Office's own monitoring of 35 public bodies, including 14 local governments in 17 districts, found procurement staff lacking training, the Rule 7 master procurement plan not prepared for purchases above Rs 100 million a year, the same staff serving repeatedly on procurement units and evaluation committees, and office chiefs themselves named as heads of procurement units. The Auditor General said the Office lacks the institutional capacity and skilled staff to train procurement staff in the numbers needed from the centre down to local governments. Office of the Auditor General, Nepal OAG 63rd Annual Report, Office of the Prime Minister and Council of Ministers chapter (Public Procurement Monitoring Office), paras 7 and 13, printed pp. 87 and 89 (PDF pp. 119 and 121)
Ideas to fix it
- Strengthen the Public Procurement Monitoring Office's institutional capacity, and set up a standing mechanism for capacity-building training and problem-solving for staff involved in procurement. Proposed by: Office of the Auditor General Office of the Auditor General, Nepal
- Develop procurement management as a separate service: give every office a procurement management unit, let only certified procurement experts carry out procurement, strengthen the Public Procurement Monitoring Office, and set separate procurement standards for different kinds of goods and services. Proposed by: High-Level Economic Reform Suggestion Commission High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance
- To reduce the rush of payments at the end of the fiscal year, pay contractors within 15 days after the work is complete and the bill is issued. (Rule 123(3) currently allows up to 30 days to approve and pay a running bill.) Proposed by: High-Level Economic Reform Suggestion Commission High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance · Ministry of Law, Justice and Parliamentary Affairs
