Electricity Theft Control Regulation, 2002

What does it do?

• Anyone who learns that electricity is being stolen must give written notice to the nearest distributor as soon as possible, on the Schedule-1 form, with any evidence they have. Notice may also be given orally, by telephone, fax or email. The distributor must register it and give the informant a receipt, and the informant's name and the content of the notice are kept confidential. • After a notice is received, the investigating officer must start the investigation as soon as possible and may ask the police, local administration and local bodies for help. The officer records the suspect's statement and carries out an on-site inspection, which must be witnessed by at least one ward committee member, three local people and, if available, the person involved. • Stolen units are estimated by assuming that each appliance in the home or building ran for the past year at the hours set in Schedules 5 and 6. The officer may count fewer or more hours on evidence, but never more than one year, and not the period before an inspection made in the past year. Meters with current or potential transformers are assessed on engineering principles. • A person who disagrees with the investigating officer's decision may apply to the distributor for review within 35 days of being notified, on the Schedule-9 form, directly or through that officer. The distributor may uphold, cancel or reduce the fine, loss and compensation. If the person pays within the time given, the case is closed; if not, the officer must start a court case. • A customer harmed by a distributor or its staff acting against the customer's interest may claim compensation from the distributor. A committee in each district, chaired by the Chief District Officer, may award up to Rs 100,000; its decision is final, and the distributor must pay within three months. Where people in an area steal electricity and cutting off only them is not technically possible, the distributor may cut supply to the area after 15 days' public notice.
