What does it do?
- No one may steal electricity or help anyone do so. The Act lists what counts as theft: tapping a line other than through the meter, hooking up street lights or other uses without the distributor's approval, reversing meter polarity, interfering with a meter's disc or breaking its seals or terminal links, damaging meters, tampering with current or potential transformers, or any other way of stealing power. It applies to electricity distributors licensed under the Electricity Act, 2049, the government and other bodies that buy and distribute power. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 3, 6–7, PDF pp. 2–4
- Distributors must put consumers' interests first, follow a code of conduct and compensate consumers whose rights are breached. They may cut the supply of anyone who does not pay the bill on time or is found stealing power, and the government may, by Gazette notice, apply special arrangements in areas badly affected by theft. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 4–5, 9–10, PDF pp. 3–6
- The distributor appoints investigation officers, who can inspect premises, cut the line immediately and assess the loss. The offender must pay the loss plus an equal amount as compensation (and the loss plus 200% for a repeat offence) before reconnection; a review of the assessment can be sought. If the offender does not pay within 35 days of notice, the case goes to the district court, which can add a fine of up to Rs 5,000 or three months in prison (Rs 10,000 or six months for repeat offences). Informants receive a reward. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 11–16, PDF pp. 6–8; Section 18, PDF p. 8
