What does it do?

  • A Nepali citizen who wants legal aid must apply to the central or district legal aid committee on the Schedule-1 form, describing the case, family situation and income. A Schedule-2 recommendation from the local ward or village body (now rural municipalities, the text notes) and any supporting documents must be attached. Someone who cannot fill in the form or come to the office may apply through a trusted person, and committee staff must register it. Nepal Law Commission Rule 3(1)-(5), PDF pp. 1-2; Schedules 1-2, PDF pp. 9-10
  • The member-secretary examines each application and puts it to the committee. The committee must decide whether to give legal aid within forty-five days of the application at most, taking into account the nature of the case and any deadline for filing or answering it, and must inform the applicant of its decision. Nepal Law Commission Rules 4 and 5(1)-(3), PDF p. 2
  • Committees may not give legal aid to anyone whose annual income is above Rs 40,000. Rule 6(2) also barred aid to people accused under certain laws, including those on espionage, human trafficking, corruption, revenue leakage and narcotics. The Law Commission text notes that the Supreme Court declared that sub-rule void on 2059-12-13, in writ no. 3553 of 2056 (Advocate Lilamani Paudel v. Council of Ministers Secretariat). Nepal Law Commission Rule 6(1)-(2) and footnote, PDF p. 3
  • If a person gains property or money because of the legal aid, they must repay the committee's costs, at ten per cent of the total property or financial gain. The central committee sets policy on valuing such gains and on waiving costs in part or in full, and district committees decide waivers within that policy. Nepal Law Commission Rule 7(1)-(2), PDF p. 3; Rules 8(ख), (घ) and 10(ग), (ङ), PDF pp. 4-6
  • District committees list lawyers, with the local bar unit, to represent people who cannot afford it in the appellate (now High) court, district court and other bodies, and set their fees within central policy. If a listed lawyer's negligence harms a case, action may be sought through the Nepal Bar Council (Legal Practitioners' Council). The central committee meets four times a year, district committees three times, and an annual report on spending and social impact goes to the government. Nepal Law Commission Rules 8(ङ), 9(1), 10(ख), (घ), (च), 11(1) and 16(1)-(2), PDF pp. 4-8
