What does it do?
- The Act provides free legal help to people who cannot protect their legal rights for economic or social reasons. An eligible ('incapable') person is someone whose annual income is below the level set in the regulations, or a victim of gender-based violence or armed conflict. Legal aid covers legal advice and representation, drafting and other legal work before courts and other authorities. Nepal Law Commission, Government of Nepal Section 2(क)–(क१), p. 2; Section 3(1), p. 3
- Legal aid committees decide who gets aid, taking care not to encourage baseless cases that harass others. If a person gains property or money through the case, they must repay the committee's costs, though the committee may waive this, and the court may order recovery in its judgment. Nepal Law Commission, Government of Nepal Sections 3(2)–(3) and 4, pp. 3–4
- Committees prepare lists of lawyers, mainly from the Nepal Bar Association, for different types of cases, and pay them fees as set in the regulations; lawyers from other districts or non-members may be listed where needed. Nepal Law Commission, Government of Nepal Section 5, pp. 4–5
- A Central Legal Aid Committee chaired by the Minister for Law, Justice and Parliamentary Affairs sets policy, oversees and funds district committees and lists lawyers for the Supreme Court. Each district has a District Legal Aid Committee chaired by the government attorney, with the women development officer and Bar representatives. A Legal Aid Fund is financed by government grants and donations, and the committees' accounts are audited by the Auditor General. Most sections apply only in areas and from dates notified in the Gazette. Nepal Law Commission, Government of Nepal Section 1(2), p. 2; Sections 6–9, pp. 5–8
