What does it do?

  • These rules apply where the government has handed a conservation area to an institution to manage under Section 16B of the National Parks and Wildlife Conservation Act. The institution sets up a head office under a chief it appoints, divides the area into sectors along natural boundaries and opens a sector conservation office in each, headed by a conservation officer. The Department names a liaison officer of at least gazetted third class to link the institution and the government; that officer hears cases under Section 31 of the Act, and officials the Department designates issue warrants and carry out inspections, searches and arrests. Nepal Law Commission Rule 2(घ), PDF p. 1; Rules 4-6, PDF pp. 2-3; Rules 31-34, PDF p. 12
  • In each village development committee inside the area, the conservation officer forms a conservation area management committee: the VDC chair, one person chosen by local users from each ward, and five local users nominated by the conservation officer so that women, backward castes and social workers are represented. Members choose a chair and secretary (not the ex officio member) and serve five years. The committee meets at least six times a year, never more than two months apart, collects fishing, forest-product, grazing and natural-resource fees and issues permits. The conservation officer may warn, suspend or dissolve a committee that breaks the plan or the rules. Nepal Law Commission Rule 8(1)-(4), PDF p. 3; Rule 9(ख), PDF p. 4; Rule 10(1), PDF p. 4; Rule 12(1)-(3), PDF p. 5
  • Each committee drafts a five-year management plan split into yearly targets; the conservation officer harmonises the plans and the chief combines them into a detailed plan for the institution to approve. When approving it, the institution must allow at least 30 percent of the money the committees earn to be spent on local users' community development. All fees a committee collects belong to the institution and must be deposited in its name, and the institution gives committees money for approved programmes. A registered auditor appointed by the institution audits each committee every year, and money lost through negligence or bad faith may be recovered like a government debt. Nepal Law Commission Rule 14(1)-(5), PDF pp. 5-7; Rule 15(1)-(2), PDF p. 7; Rule 26(1)-(3), PDF p. 11; Rule 28(1)-(4), PDF p. 11
  • Without the chief's written permission, no one may hunt, cut or damage forest products or set fires, mine or quarry, harm wildlife, birds or public land, carry or use weapons, ammunition or poison, use electric current in rivers or streams, or land helicopters or drop people or things from them; the chief may exempt some zones. Starting commercial work that uses or affects the area's natural resources needs a permit from the chief, with priority for local users. Hotels, lodges and transport may be run under contract with the institution, and action on the use of water resources needs the consent of the Ministry of Forest and Soil Conservation. Nepal Law Commission Rule 16(1)-(2), PDF p. 8; Rule 21(1)-(3), PDF pp. 9-10; Rule 22, PDF p. 10; Rule 39, PDF p. 13
