Public Service Commission Act, 2022

What does it do?

• The Act sets how the Public Service Commission, a constitutional body, selects candidates for the federal civil service, security agencies, other federal government services and public enterprises, so that recruitment is fair and merit-based. Bodies must consult the Commission on minimum qualifications, and the Commission decides whether a degree is equivalent to the required qualification, binding for all candidates with the same degree. • Agencies send vacancy requests to the Commission; security agencies, other services and public enterprises need its consent before advertising. The Commission fixes the number of posts for open competition, promotion and inclusive quotas under the service laws, advertises, runs written, practical and interview stages using coded answer sheets, publishes results and recommends appointments.निकायले रिक्त पदको माग आयोगमा पठाउँछन्; सुरक्षा निकाय, अन्य सेवा र संगठित संस्थाले विज्ञापन गर्नुअघि आयोगको सहमति लिनुपर्छ। आयोगले सेवा कानूनबमोजिम खुला, बढुवा र समावेशी पद सङ्ख्या निर्धारण गर्छ, विज्ञापन गर्छ, सङ्केत नम्बर प्रयोग गरी लिखित, प्रयोगात्मक र अन्तर्वार्ता चरण सञ्चालन गर्छ, नतिजा प्रकाशित गर्छ र नियुक्तिका लागि सिफारिस गर्छ। Nepal Law Commission, Government of Nepal Sections 12–30, pp. 4–9
• The Commission must be consulted on general principles for promotion and discipline, on departmental punishment of federal civil servants (advice within 30 days) and on candidates' suitability for long appointments, transfers and service changes; it monitors compliance and may correct or void actions taken in breach. Cheating, impersonation, leaking exam papers, disrupting exam centres and similar acts are offences, punishable by bans from future exams and, for the most serious, a Rs 50,000–100,000 fine and three to six months' prison.
