What does it do?

  • The Act consolidates sports law and re-establishes the National Sports Council as an autonomous body to develop, expand, promote and manage sport. The Council includes government, security-force and university sports heads, the executive heads of each province's sports body and nine nominated distinguished sports people (at least three women, drawn from all provinces and inclusive of Dalit, Adivasi Janajati, Madhesi, Tharu, Muslim and other groups, half of them former national or international players). It approves annual plans and budgets, sets standards for support to sports bodies and players, sport infrastructure and player classification, and promotes players' social security. Nepal Law Commission, Government of Nepal Sections 3 and 9, pp. 2–7
  • Sports associations and national federations must register with the Council, get approval for changes and follow set conditions; the Council can suspend them. Provinces and local levels may form sports associations and build sports structures. The Nepal Olympic Committee is recognised, the government may name a national game and indigenous and traditional games, and a National Anti-Doping Agency and a players' welfare fund are provided for. Nepal Law Commission, Government of Nepal Sections 22–29, pp. 15–20; Sections 37–39, 43 and 50, pp. 23–26
  • Doping, forcing players to dope, match-fixing and manipulation, breaching the code of conduct, discrimination or violence against players, and registering with false details are offences. Match-fixing carries three years' prison and up to Rs 50,000 fine plus confiscation of money involved, with extra prison for public office holders or national representatives who do it abroad. District courts try the criminal offences, while the Council decides discrimination, code-of-conduct and false-registration cases, with appeals to the district and High Courts. Nepal Law Commission, Government of Nepal Sections 30–35, pp. 21–22
  • The Ministry of Youth and Sports must measure the Act's implementation and the government may issue directions; the Council's staff structure must follow an organisation and management survey approved by the Cabinet. Nepal Law Commission, Government of Nepal Sections 19, 51 and 57, pp. 13, 26–27

Gaps, loopholes and improvement ideas

  • Not enforced Key duties under section 9 are not carried out. In FY 2080/81 the National Sports Council received Rs 1.79 billion and spent Rs 1.50 billion without preparing and approving an annual budget and programme; it had not set standards for support and scholarships to sports bodies and players, sport infrastructure, operating procedures, private sports facilities or player classification, nor acted on players' social security; and it had not adjusted its staff structure as section 19 requires. Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 62nd Report, MoYS chapter, National Sports Council paras 19–21, printed pp. 420–421; Act ss. 9 and 19, pp. 5–7, 13
  • Unclear The division of roles between the federal and provincial sports councils is unclear. Provinces have passed their own sports acts and councils, and sports bodies must register with and are regulated by both levels; the Auditor General said the Act should be revised to make the National Sports Council's and provincial councils' jurisdictions clear. Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 63rd Report, MoYS chapter, para 7, printed p. 354; Act ss. 24–26, pp. 16–18

Ideas to fix it

  • Amend the Sports Development Act so that the jurisdictions of the National Sports Council and the provincial sports councils are clear. Proposed by: Office of the Auditor General (63rd Annual Report) Office of the Auditor General, Nepal
  • Approve the annual programme and budget before spending, and carry out the Council's statutory tasks. Proposed by: Office of the Auditor General (62nd Annual Report) Office of the Auditor General, Nepal
