What does it do?
- The Forests Act 2076 consolidates Nepal's forest law. National forests are managed as government-managed forests, protection forests, community forests, collaborative forests, leasehold forests and religious forests, while private, public and urban forests are promoted. Ownership of national forest land stays with the Government of Nepal; without a Cabinet decision, its land use cannot be changed and no one may be given rights to it by sale, mortgage or other transfer. National forest land may not be registered in anyone's name, and such registrations are void. Nepal Law Commission, Government of Nepal Preamble, p. 1; Sections 3 and 7–8, pp. 4–5
- Responsibilities are shared across the federal structure. The federal government, together with the provinces, fixes the boundaries of provincial forests and prepares province-level strategic plans; provinces manage the national forests within their territory, and Division Forest Officers prepare and implement operational plans. Local user groups can take over parts of national forest as community forests on the basis of an operational plan approved by the Division Forest Officer; collaborative forests are run jointly by the Division Forest Office, local governments and users, and the government may lease degraded forest to organisations for purposes such as raw materials for forest-based industries. Local governments can develop urban forests. Nepal Law Commission, Government of Nepal Sections 4 and 11, pp. 4–6; Section 18, p. 8; Sections 23 and 26, pp. 10–11; Section 38, p. 16
- Forest land may not be converted to other uses. The exception is when the Cabinet allows part of a national forest to be used for a national priority project, an Investment Board project, a national pride project or a licensed mining industry, and only if there is no alternative and an environmental study finds no significant harm; provinces and local governments must also go through the Cabinet. The project must provide equivalent land and plant and maintain trees there for five years (or pay for this), and must deposit money to replace felled trees into the Forest Development Fund, which also receives government grants and other income. Transmission-line and communication tower projects follow a separate rule. Nepal Law Commission, Government of Nepal Sections 41–42, pp. 16–18; Section 45, p. 19
- Encroaching on national forest, illegal felling and other listed acts are offences. An Armed Forest Guard service protects forests and stops timber smuggling. Forest officials can arrest suspects and search premises, and Division Forest Officers decide cases punishable by up to Rs 200,000 in fines or one year's imprisonment, following the Special Court Act procedure; cases are brought by the Government of Nepal. Nepal Law Commission, Government of Nepal Section 46, p. 20; Sections 49–50, pp. 22–24; Sections 58–59, pp. 25–26; Sections 63 and 67, pp. 28–29
Gaps, loopholes and improvement ideas
- Not enforced Encroachment on national forest continues. Section 49 makes encroachment an offence, but the Auditor General, using the forest ministry's own figures, reported that 104,000 hectares of forest were encroached in 65 districts, and found in 2081/82 that programmes to stop encroachment had not been implemented effectively and data on encroachment were not kept up to date. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 63rd Annual Report, Ministry of Forests and Environment chapter, para 12, printed p. 383 (PDF p. 415); OAG 62nd Annual Report, chapter 3 summary, para 51, printed p. 32 (PDF p. 60); Act s. 49, p. 22
- Not enforced Payments owed for using forest land are not collected in full. Projects given forest land under Section 42 must pay into the Forest Development Fund under Section 45. By 2081/82 the Fund had received Rs 3.37 billion, but of 671 organisations given forest land, 38, including the Kathmandu–Terai Expressway, the Madan Bhandari Highway and transmission and irrigation projects, still owed Rs 4.93 billion; Rs 517.3 million paid by ten organisations between 2076/77 and 2078/79 was lying in other agencies' accounts instead of the Fund. A year earlier the outstanding amount was Rs 1.45 billion from 12 organisations. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 63rd Annual Report, Ministry of Forests and Environment chapter, para 14 (14.1–14.2), printed p. 385 (PDF p. 417); OAG 62nd Annual Report, chapter 3 summary, para 52, printed pp. 32–33 (PDF pp. 60–61); Act ss. 42 and 45, pp. 16–19
Ideas to fix it
- Update data on forest encroachment and make forest protection work effective. Proposed by: Office of the Auditor General (63rd Annual Report) Office of the Auditor General, Nepal
- Recover the amounts owed to the Forest Development Fund by organisations given forest land, and transfer money held in other agencies' accounts into the Fund. Proposed by: Office of the Auditor General (62nd and 63rd Annual Reports) Office of the Auditor General, Nepal · Office of the Auditor General, Nepal
