What does it do?
- The Act gives victims of crime a set of rights during the criminal process: to fair treatment without discrimination, to privacy, to be told about the investigation, the prosecution decision and court hearings, to protection, to give their views, to have a lawyer, to attend hearings (and wait in a separate room), and to get back their property. Police, prosecutors and courts must respect these rights, and a victim may apply to the court to enforce them. Nepal Law Commission, Government of Nepal Sections 4–15, pp. 5–11; Sections 22–23, p. 13
- A victim may submit a 'victim impact statement' describing the harm suffered, which the court may take into account when sentencing; not submitting one does not mean the harm was smaller. Nepal Law Commission, Government of Nepal Sections 25–28, pp. 14–15
- Courts may order interim relief or medical treatment paid from the Victim Relief Fund, and at the end of a case order the offender to pay compensation, based on medical and counselling costs, travel, legal fees, loss of earnings and other harm. If the offender has no property, cannot be identified or the case is withdrawn, the court may order compensation from the Fund, to be paid within 35 days. Compensation is collected from the offender like a government debt. Nepal Law Commission, Government of Nepal Sections 29–31, pp. 15–17; Sections 36–39, pp. 20–21
- Every convicted offender must also pay a 'compensation levy' into the Fund, set by the court at judgment: from Rs 200 for a prison sentence under one year up to Rs 2,800 for life imprisonment, or 4% of the fine where only a fine is imposed. The levy remains payable even if the sentence is pardoned, reduced or suspended. Nepal Law Commission, Government of Nepal Sections 41–42, pp. 21–22
- A Victim Protection Advisory Committee led by the Attorney General, with the Law Commission chair, the Finance and Law secretaries, the Inspector General of Police and an expert, advises the government on improving the law and protecting victims. Nepal Law Commission, Government of Nepal Sections 44–45, pp. 23–24
