President and Vice President Election Act, 2074

What does it do?

• The President and Vice President are elected by an electoral college of all members of the Federal Parliament and the provincial assemblies; vacancies or an unelected provincial assembly do not stop the college being formed. • A candidate must be a Nepali citizen by descent, at least 45 years old, on a local voter roll, not disqualified by federal law and not holding an office of profit. Each nomination needs five proposers and five seconders from the electoral college, and a person may be nominated by at most two nomination papers. • Votes are weighted: each member's vote counts according to a formula in the Schedule based on total population (using the 2068 census figures as the example, 79 for a federal MP and 48 for a provincial assembly member). • The Act regulates the voter list, nominations and objections, polling and counting (including help for voters with disabilities and secrecy of the ballot), and requires candidates to keep within a campaign spending limit set by the Election Commission in the Nepal Gazette and to keep accounts of all election spending.
