What does it do?

  • Only companies licensed by the Department of Commerce may run a direct-selling (door-to-door or distributor-network) business in the goods the government specifies. An applicant company must have paid-up capital of at least Rs 10 million and submit its business plan and commission-sharing scheme. • Pyramid-based business is banned outright. The Act defines it to include schemes that require paid membership before buying, force package purchases, leave buyers unable to recover what they paid unless they recruit others, earn only from recruitment fees without real trade, lure members with unrealistic gifts or commissions, or sell products as miracle cures. Running such a scheme is punishable by a fine equal to the amount involved or, if no amount is established, Rs 500,000 to Rs 1 million, and/or three to five years in prison; founders and directors of the company are liable. Nepal Law Commission Section 11 and explanation, pp. 6–7; Section 36(b), p. 21; Section 37(1)(b) and (2), pp. 21–22
