What does it do?

• The Act sets out how the Justice Service Commission carries out its constitutional duties: recommending the appointment, transfer and promotion of gazetted officers of the federal judicial service, giving advice before they are given departmental punishment, and holding the examinations used to recommend district judges. • For gazetted second-class and higher posts, the agency concerned sends a vacancy demand. The Commission decides how many posts will be filled by open competition, internal competition or promotion under the service law, and asks the Public Service Commission to run the exams for the competitive posts. Its recommendations must follow the service law and the constitutional principle of proportional inclusion, and it must publish an annual calendar. • When the Judicial Council asks it to fill district judge posts, the Commission advertises the vacancies and runs the exam, with a syllabus set in consultation with the Public Service Commission, the Judicial Council and subject experts. Answer sheets are coded for anonymity, and successful candidates are recommended to the Judicial Council in order of merit.
