What does it do?

  • The Act applies to property obtained directly or indirectly from any criminal offence prosecuted by the state, and to instruments used or intended for an offence, whoever holds them. During an investigation the investigating officer must trace such property and may immediately freeze or take control of it; if it has been hidden, used up or disposed of, property of equal value belonging to the suspect may be frozen instead. Since a 2082 amendment, holding property for more than 180 days requires court permission. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 2(ग)–(ङ), PDF p. 2; Sections 3–4, PDF pp. 3–4
  • Frozen or seized property must be handed over, with cash and foreign currency deposited in a bank or deposit account and kept safe, and details sent to the relevant bodies; mutual legal assistance is used for property abroad. Once a court's decision is final, the proceeds or instruments are confiscated — or other property of the offender of equal value if they cannot be. The court must protect the rights of innocent third parties who did not know of the offence. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 5–10, PDF pp. 4–6; Sections 11–12, PDF pp. 6–7
  • A Department of Management of Proceeds of Crime, headed by a Director General of at least gazetted first class, manages frozen and confiscated property. After a court decision becomes final, confiscated property must be auctioned without delay by the Department or the District Administration Office, following valuation rules in the Act; property not suitable for auction may be used by the government. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 13–14, PDF pp. 7–8; Sections 17–21, PDF pp. 9–14
  • Confiscated property and auction proceeds go into a Proceeds of Crime Management Fund run by a committee chaired by the Finance Secretary. The Fund is used to share proceeds with foreign countries under foreign court orders, return deposits or property as ordered by courts, and pay the rest into the Consolidated Fund; the government may also use it for legal reform and for building the capacity of people working on crime prevention, investigation, prosecution and justice. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 22–26, PDF pp. 14–16

Gaps, loopholes and improvement ideas

  • Not enforced The Auditor General found that some court-ordered confiscations have not yet been carried out. Section 17 requires confiscated property to be auctioned without delay once a court decision is final (or used by the government), but the Auditor General found in FY 2081/82 that land of 8 defendants, 66,000 shares (face value Rs 6.6 million) of 5 defendants and Rs 6.11 million plus interest held for 13 defendants in 15 banks were still being used by the defendants despite confiscation orders; nothing had been auctioned into the Fund or used by the government. The 62nd report had found a similar situation (land of 19 defendants, shares worth Rs 6.5 million, and Rs 5.165 million in 17 banks). Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 63rd report, Home Affairs chapter para 12 (PDF pp. 297–298, printed pp. 265–266); OAG 62nd report, Home Affairs chapter para 13 (PDF p. 334, printed p. 304); Act Section 17(1), PDF p. 9

Ideas to fix it

  • Carry out the Act's provisions: auction confiscated property into the Proceeds of Crime Management Fund or put it to government use. Proposed by: Office of the Auditor General (62nd and 63rd Annual Reports) Office of the Auditor General, Nepal · Office of the Auditor General, Nepal
