What does it do?
- The Act aims to stop plant pests entering, establishing and spreading through the import, export and movement of plants and plant products, to control pesticides' risks to national biosecurity and to promote trade in plants. A committee under the Act sets policy, and the government designates a central office (the National Plant Protection Organisation) to prepare plant-health standards and pest lists, inspection and treatment guidelines and fees, and to agree mutual recognition of certificates with other countries. Nepal Law Commission, Government of Nepal Preamble; Sections 3–6, pp. 1–8
- Anyone importing plants, plant products, biological control agents, beneficial insects or growing media such as soil or peat needs an import permit (valid three months, renewable) under conditions the Ministry sets in the Gazette, plus an entry permit at the border point. Exports and re-exports need a phytosanitary certificate, which may be issued electronically (e-Phyto), and consignments in transit need permission. Nepal Law Commission, Government of Nepal Sections 7–13, pp. 8–11
- Plant quarantine inspectors inspect, test and treat consignments, carry out pest risk analysis, and the government may declare quarantine-pest affected areas and control pests there. Infected goods are treated, or confiscated and destroyed, at the importer's or exporter's cost. Nepal Law Commission, Government of Nepal Sections 14–21, pp. 11–14; Sections 24–25, p. 16
- Offences include importing without a permit or certificate, bringing in or selling infected plants, using unauthorised entry points and obstructing inspectors. Fines range from Rs 10,000–50,000 to Rs 50,000–150,000 depending on the offence, and the office chief may fine up to Rs 100,000 for disobeying treatment orders; cases are investigated by inspectors with the government as plaintiff. Nepal Law Commission, Government of Nepal Sections 22–23, pp. 15–16; Sections 27–29, p. 17
