Non-resident Nepali Act, 2064

What does it do?

• The Act aims to strengthen non-resident Nepalis' ties with Nepal and encourage them to take part in its development. A 'non-resident Nepali' is a person holding non-resident Nepali citizenship, a foreign citizen of Nepali origin (someone who, or whose parent or grandparent, was a Nepali citizen and who took citizenship of a country outside SAARC), or a Nepali citizen who has lived and worked abroad outside SAARC for at least two years (excluding diplomats and students). A 2081 amendment added the category of non-resident Nepali citizenship holders.गैरआवासीय नेपालीको नेपालप्रतिको सामीप्य बढाई उनीहरूलाई नेपालको सर्वाङ्गीण विकासमा सहभागी हुन प्रेरित गर्नु यो ऐनको उद्देश्य हो। ‘गैरआवासीय नेपाली’ भन्नाले गैरआवासीय नेपाली नागरिकता प्राप्त व्यक्ति, नेपाली मूलका विदेशी नागरिक (आफू वा बाबु, आमा, बाजे वा बज्यै नेपाली नागरिक भई पछि सार्कबाहिरका मुलुकको नागरिकता लिएका व्यक्ति), र सार्कबाहिरका मुलुकमा कम्तीमा दुई वर्ष बसेर पेशा, व्यवसाय वा रोजगारी गरेका नेपाली नागरिक (कूटनीतिक नियोगका कर्मचारी र विद्यार्थीबाहेक) पर्छन्। २०८१ को संशोधनले गैरआवासीय नेपाली नागरिकता प्राप्त व्यक्तिलाई यो परिभाषामा थपेको हो। Nepal Law Commission, Government of Nepal Preamble and Section 2(a)–(c), pp. 1–2
• A non-resident Nepali can apply to the designated official to be entered in the official record and receive an identity card. For foreign citizens of Nepali origin the card lasts up to ten years, subject to their visa; for Nepali citizens abroad it lasts two years, or longer if their foreign residence permit is longer. • Card holders may open foreign-currency accounts in licensed banks and invest money earned abroad in convertible foreign currency in industries open to foreign investment, or in others the government opens to them, and they may take back the investment and its returns in foreign currency. • Foreign citizens of Nepali origin may buy land or other property in Nepal for their own or their family's residence within limits set by the rules, may run businesses like Nepali citizens, and, with their families, can get a non-resident Nepali visa free of charge for up to ten years; holders of non-resident Nepali citizenship get a free two-year multiple-entry visa.
