What does it do?
- The Act bans agreements between businesses that produce or distribute similar goods or services to fix purchase or sale prices or terms, limit or control production, distribution or technical development, or share out markets. A business with a dominant position may not abuse it to control competition, and businesses may not merge, combine, or buy 50% or more of a competitor's shares or take it over in order to create a monopoly or a controlled market. Nepal Law Commission Sections 3–5, pp. 3–7
- It also prohibits bid-rigging in public tenders (such as agreeing not to bid, agreeing identical prices or sharing bid information), exclusive dealing, limiting markets, tied selling and misleading advertising. Nepal Law Commission Sections 6–10, pp. 7–9
- A Competition Promotion and Market Protection Board, chaired by the Secretary of the Ministry of Industry, Commerce and Supplies with representatives of the Law, Finance and Industry ministries two government nominees from business associations and others, recommends competition policy, reviews competition law and raises awareness. Market protection officers designated by the government in districts investigate complaints — which anyone may file, anonymously if they wish — and bring cases to court, which uses summary procedure; the Government of Nepal is the plaintiff. Nepal Law Commission Sections 12–14, pp. 10–12; Sections 22–28, pp. 14–16

Where does it conflict with other laws?
The High-Level Economic Reform Suggestion Commission found that market abuses are covered by several overlapping laws — the 2032 Black-Market Act, this Act (which it said promotes good market practice), the Consumer Protection Act, 2075 and Sections 107–110 of the Muluki Criminal Code — and that using different laws for the same matter has allowed different government bodies and officials to harass businesses, which it said has at times happened. It concluded the Black-Market Act is wholly irrelevant. High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance Legal-reform analysis item 6, printed pp. 84–85 (PDF pp. 151–152)
