What does it do?
- To decide particular kinds of cases quickly and effectively, the Government may, by Gazette notice and in consultation with the Judicial Council, form a Special Court and add or remove the types of cases it hears (in practice, the corruption and similar cases that the relevant laws send to it). The chair and members are designated from among appellate-level judges in consultation with the Judicial Council; where there are more than three members, benches of three are formed, and the Government sets the court's territorial jurisdiction and seat. Nepal Law Commission Sections 3–5, pp. 2–3
- The Special Court hears such cases at first instance. Benches decide collectively, with majority decisions where three members sit; single-member benches may handle only procedural matters other than detention, and two-member benches may decide detention and cases. The court may order an accused person's property frozen and passport withheld or not issued, allow supplementary charge sheets, and use special rules on summons and hearing dates; it can punish contempt. Nepal Law Commission Sections 6–14, pp. 3–7
- The Special Court should normally decide a case within six months of filing. Appeals lie to the Supreme Court within 35 days, and the Supreme Court should normally decide them within three months of receiving the file. Gazette notices under the Act must be tabled in Parliament, and the Government provides staff and may dissolve a Special Court by notice. Nepal Law Commission Sections 16–21, pp. 7–8
