What does it do?

  • The Act sets up the Road Board, an autonomous body, to arrange road maintenance, reduce maintenance costs and make maintenance transparent and effective. The Board funds road agencies for maintenance on the basis of the annual maintenance programmes they submit, prepares an integrated annual maintenance programme, may arrange rehabilitation, reconstruction and upgrading of roads, and must prepare action plans to reduce maintenance costs. A share of the toll collected from a particular road must be spent on maintaining that road. Nepal Law Commission, Government of Nepal Preamble, p. 1; Sections 3–5, pp. 3–4; Sections 14–16, p. 8
  • The government may, by Gazette notice, levy road-user charges, a fuel levy, a charge on vehicle registration certificates and a charge on foreign-registered vehicles entering Nepal; the Board collects them, and may contract out collection of some charges. Its fund also receives government grants and other income and may be spent only on maintenance and related purposes. The Board's accounts are audited by the Auditor General, and it must submit an annual report. Nepal Law Commission, Government of Nepal Sections 6–7, pp. 4–5; Sections 24–25, pp. 10–11; Section 27, p. 12; Section 37, p. 13
  • The Board's work is run by an executive committee that includes, besides government members, representatives of the municipalities' association, the Federation of Nepalese Chambers of Commerce and Industry, the Nepal Engineers' Association, transport operators, consumers and commercial farmers, with the Executive Director serving as its secretary. Nepal Law Commission, Government of Nepal Section 8, pp. 5–6; Sections 21–22, pp. 9–10
  • Driving a vehicle without paying the charge can draw a fine of up to Rs 1,000, rising to Rs 5,000 for each repeat. Until the charge or fine is paid, the Board can ask the authorities to bar the vehicle from use, suspend its registration or permit, or suspend the driver's licence. Nepal Law Commission, Government of Nepal Sections 28–30, p. 12

Gaps, loopholes and improvement ideas

  • Not enforced Key duties under the Act are not carried out in practice. The Auditor General's performance audit of national highway maintenance found that there was no adequate policy and legal framework for road maintenance, and that provisions of the Road Board Act 2058, such as action plans to cut maintenance costs, spending the fund on road safety by priority, enforcing vehicle axle-load standards, and investigating and fining violations, had not been applied. It also reported that coordination, planning and quality control need strengthening, and that deadlines were repeatedly extended. Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 63rd Annual Report, chapter 3 summary, para 118 (performance audit of national highway maintenance), printed p. 51 (PDF pp. 81–82); Act s. 5(i)–(j), p. 4
  • Capacity The Board's accounts and planning need strengthening. For FY 2081/82 the Auditor General could not confirm that the Board's financial statements were accurate because it used a mixed accounting system instead of the government cash system required by its rules; it had not recorded Rs 157.4 million due from road-toll contracts, carried a negative balance of Rs 2.31 billion, had not prepared the periodic integrated programme for road rehabilitation and safety, and had not recovered Rs 233.5 million in advances given to local governments and district coordination committees. Office of the Auditor General, Nepal OAG 63rd Annual Report, MoPIT chapter, Road Board Nepal, paras 74–77, printed pp. 342–343 (PDF pp. 374–375)

Ideas to fix it

  • Keep accounts and report according to accepted accounting principles and standards, monitor the standard and quality of roads built and repaired, and recover or settle outstanding advances. Proposed by: Office of the Auditor General (63rd Annual Report) Office of the Auditor General, Nepal
