What does it do?

  • The Act establishes the Armed Police Force, Nepal, headed by an Inspector General of the Armed Police with a four-year term and headquartered in the Kathmandu Valley. The government supervises, controls and directs the Force, and the Force must follow the government's orders and instructions. Nepal Law Commission, Government of Nepal Sections 3–5, p. 3; Section 9(2), p. 6
  • The government may deploy the Force to control armed conflict, armed rebellion or separatist activity, terrorist activity and riots; to help rescue people in disasters and epidemics; to rescue kidnapped people and control serious crime or unrest; to guard the border; to assist the Nepali Army under its command if there is external attack; to protect public buildings and structures and people the government decides to protect; and for other tasks the government assigns. When the Force is deployed, the government must inform the National Security Council and a Central Security Committee, chaired by the Home Minister, at least once a week. Nepal Law Commission, Government of Nepal Section 6, pp. 3–5; Section 7, p. 5
  • Recruitment and promotion of officers are recommended by an Armed Police Service Commission chaired by the Chair or a member of the Public Service Commission. The Act sets service conditions, departmental action and suspension, and a list of offences by Force members, punishable by up to life imprisonment for the most serious ones. Nepal Law Commission, Government of Nepal Section 11, p. 6; Sections 19–20, pp. 8–9; Section 27, pp. 11–13
  • Offences under the Act by Force members are tried by an Armed Police Special Court based in Kathmandu that includes a judicial-service officer; its decisions can be appealed to the High Court within 35 days. Nepal Law Commission, Government of Nepal Sections 28–33, pp. 13–14

Gaps, loopholes and improvement ideas

  • Outdated The law has not been updated for the federal structure. The Auditor General reported that a bill to amend and consolidate the law on the Armed Police Force, Nepal (2081) had been registered in the Federal Parliament Secretariat but had not been enacted, and said laws should be brought in line with the governance structure. Office of the Auditor General, Nepal OAG 63rd Annual Report, MoHA chapter, para 9, printed p. 265 (PDF p. 297)
  • Unclear Fees for guarding projects are unclear. Section 6 lets the government deploy the Force to protect public structures. The Auditor General found 419 Armed Police personnel posted at 14 sites, including hydropower and national pride projects, some of which are separately registered entities, without clarity on the pay and service fee payable for that security; by comparison the Nepali Army had deposited Rs 205.3 million into the Consolidated Fund as a fee for guarding Nepal Rastra Bank. Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 63rd Annual Report, MoHA chapter, Armed Police Force para 31, printed pp. 273–274 (PDF pp. 305–306); Act s. 6(1)(i)–(j), p. 4

Ideas to fix it

  • Make the fee for security services provided by the Armed Police Force clear. Proposed by: Office of the Auditor General (63rd Annual Report) Office of the Auditor General, Nepal
