What does it do?
- No one may employ a child under 14 as a worker. No one may employ any child (anyone under 18, under the current definition) in the hazardous occupations and work listed in the Act's schedule, or make a child work against his or her will by luring, deceiving, frightening or pressuring them. The Act applies to 'establishments' and 'managers' as defined in the Labour Act, 2074. Nepal Law Commission, Government of Nepal Section 2(a)–(c), p. 2; Sections 3–4, p. 3
- An establishment that wants to employ a child (aged 14 or over, in non-hazardous work) needs approval from the Labour Office and from the child's parent or guardian, and a one-year certificate of fitness from a doctor arranged by the Labour Office. Children may not work between 6 pm and 6 am, or more than 6 hours a day or 36 hours a week. They must get a half-hour break after every 3 hours and one day off a week, and must receive equal pay for equal work without discrimination. Nepal Law Commission, Government of Nepal Sections 6–7, p. 4; Sections 9–10, pp. 5–6
- Managers must keep a register of every child employed and post the rules, pay and penalties on the notice board. The Labour Office sends inspectors, who can enter at any time. If they find a child working in breach of sections 3 or 4, they must hand the child to the parents or guardian and order the manager to remove the child from work. Nepal Law Commission, Government of Nepal Sections 13–16, pp. 6–7
- Employing a child under 14 is punishable by up to three months' prison and/or a fine of up to Rs 10,000. Using a child in hazardous work or against their will is punishable by up to one year and/or Rs 50,000, and penalties double for repeat offences. Complaints may be made within one year by inspectors, police, the child or the child's family, local governments, trade unions or child-rights organisations. The Labour Office imposes penalties, but a prison sentence must go through the Labour Court, and appeals go to the Labour Court or the High Court. The government forms a Child Labour Elimination Committee and a Child Labour Elimination Fund. Nepal Law Commission, Government of Nepal Sections 19–24, pp. 9–11
