What does it do?

  • The Building Act regulates construction so that buildings are as safe as possible from earthquakes, fire and other disasters. It covers residential, industrial, commercial and other buildings, and 'construction' includes building, adding storeys or altering existing buildings. The Act takes effect in areas the government notifies in the Nepal Gazette. Nepal Law Commission, Government of Nepal Preamble and Sections 1–2, pp. 1–2
  • A Building Construction System Improvement Committee, chaired by the Secretary of the Ministry of Urban Development with the Director General of the Department of Urban Development and Building Construction as member-secretary, prepares the National Building Code, which takes effect once the ministry approves it. The Act sorts buildings into four classes: 'A' (built to international state-of-the-art codes), 'B' (plinth area over 1,000 sq ft, more than three storeys including the ground floor, or structural span over 4.5 m), 'C' (up to those limits) and 'D' (small brick, stone, mud or bamboo houses of up to two storeys). Nepal Law Commission, Government of Nepal Sections 3–4, pp. 2–4; Sections 8–9, pp. 5–6
  • Every building must be built to the standard set in the Building Code, under the supervision of a technician at least as qualified as the one who certified its design. When applying to a municipality (or, in rural municipalities covered by the Act, to the urban development office) for permission, owners of A, B and C class buildings must submit designs certified by qualified engineers or architects. Municipalities may not approve maps that breach the Code; the urban development office can check approvals and the Committee can require them to be corrected. Nepal Law Commission, Government of Nepal Sections 10–12, pp. 6–7
  • Municipalities (or urban development offices) can supervise construction and order work that breaches the Code to be stopped. Building without an approved map or against the Code can lead to an order to demolish the building or part of it and a fine of up to Rs 50,000 on the person responsible; a building under a demolition order cannot be transferred or mortgaged and may be denied water, electricity and telephone connections. These orders can be appealed to the district court within 35 days. Nepal Law Commission, Government of Nepal Sections 13–15, pp. 7–9

Gaps, loopholes and improvement ideas

Ideas to fix it

  • Formulate a new national building policy and amend the Building Act accordingly, extending its scope to cover local architecture, technology and construction materials as well as modern technology and materials; set minimum qualifications and experience for building designers and builders, require them to register, and regulate the informal contractors and small builders involved in private house construction. Proposed by: High-Level Economic Reform Suggestion Commission (2081) High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance
