What does it do?
- The Act creates the Nepal Health Service, a separate government service for health workers, with officer levels (sixth to twelfth) and assistant levels (third to fifth), specialist and technical posts in groups and sub-groups, and job descriptions set by the Ministry of Health and Population. A 2070 amendment moved village health workers and maternal and child health workers to the fourth level as Auxiliary Health Workers and Auxiliary Nurse-Midwives. Nepal Law Commission Sections 3–7, pp. 3–9
- Posts filled by open or internal competition are filled on the recommendation of the Public Service Commission. Promotions to officer posts are recommended by a promotion committee on a 100-mark score: 40 for performance evaluation, 20 for seniority, 25 for service in geographical areas and 15 for education and training. Nepal Law Commission Section 10, p. 13; Sections 24 and 29, pp. 21–26
- Transfers must give staff experience of very remote, remote and accessible areas. Staff should not normally be transferred before completing one year in a very remote area or two years in a remote area, and no one may be put on deputation (kaaj) for more than 30 days a year; pay for longer deputations is to be recovered from the official who ordered it. Nepal Law Commission · Office of the Auditor General, Nepal Act s. 21(1)–(4), pp. 18–19; deputation-pay recovery as summarised in OAG 62nd Annual Report, MoHP chapter, para 15, printed p. 578 (PDF p. 608)
- Health workers retire at 60, with up to three more years possible where the government urgently needs a specialist; the Act also sets pay, gratuity, pension, leave, conduct rules (including bans on political activity and strikes that obstruct work) and the right to form trade unions. Departmental penalties range from a warning or withheld promotion to dismissal; appeals against dismissal go to the Administrative Court. The Ministry of General Administration supervises compliance with the Act through management audits. Nepal Law Commission Section 45, pp. 33–34; Sections 47–48, pp. 34–36; Sections 52–67, pp. 37–41; Sections 72 and 76, pp. 43–47; Section 88, pp. 50–51; Section 92ka, p. 51
Gaps, loopholes and improvement ideas
- Not enforced Transfer and deputation rules are not followed. The Auditor General's 62nd report found that in 2080/81 the Ministry of Health and Population transferred 27 staff before they had served the minimum period required by Section 21, and put 63 staff on deputation to federal, provincial and local bodies without posts and without any fixed end date. The same report found 207 staff (auxiliary nurse-midwives, lab assistants, darkroom assistants and others) still kept in reserve without assignment five years after the Employee Adjustment Act took effect. Office of the Auditor General, Nepal · Nepal Law Commission OAG 62nd Annual Report, Ministry of Health and Population chapter, paras 14–15, printed pp. 577–578 (PDF pp. 607–608); Act s. 21(3)–(4), p. 19
Ideas to fix it
- Make transfers and deputations only as the law allows, hold the responsible officials accountable for the extra costs, and complete the adjustment of staff kept in reserve as soon as possible. Proposed by: Office of the Auditor General (62nd Annual Report) Office of the Auditor General, Nepal
