What does it do?

  • The Act protects and promotes breastfeeding by controlling how breast-milk substitutes, other baby foods, feeding bottles and teats are marketed. The Ministry of Health is responsible for enforcing it, advised by a Breastfeeding Protection and Promotion Committee chaired by the Health Secretary that supervises compliance. Nepal Law Commission, Government of Nepal Sections 3–4, pp. 4–5
  • Manufacturers and distributors may not advertise or promote these products to the public, give free samples, promote them inside health facilities, contact mothers there, or give gifts or money to health workers. Advertising is allowed only in publications for health professionals and must stick to scientific facts. Information material about infant feeding must explain the benefits of breastfeeding and the costs and risks of substitutes. Nepal Law Commission, Government of Nepal Sections 7–9, pp. 6–10
  • Health workers must protect and encourage breastfeeding, may not accept gifts from manufacturers, give samples or promote products, and must report any offer of a gift or other breach to the head of their institution, who informs the Committee. Nepal Law Commission, Government of Nepal Section 8, pp. 7–8
  • Before sale, products (other than bottles and teats) must be tested and certified by the Central Food Research Laboratory, and labels must be approved by the Committee, written in Nepali, show no pictures except preparation graphics, and carry the maker's name and address. Expired products and products not meeting safety standards in the country of origin may not be sold. Nepal Law Commission, Government of Nepal Sections 10–12, pp. 10–12
  • Inspectors appointed by the Ministry check compliance and investigate offences, which are prosecuted by the government in the District Court. Penalties include up to Rs 15,000 fine or four months' prison for selling without certification or label approval, and up to Rs 1,000 or one month for health workers who breach the rules; courts may also award Rs 25,000–100,000 compensation to a person harmed. The Ministry may ask for a violator's licence to be suspended or cancelled. Nepal Law Commission, Government of Nepal Sections 13–19, pp. 12–13
