What does it do?
- Anyone running a printing press must register it with the 'local officer' (the Chief District Officer unless the government designates someone else) and obtain a certificate; moving the press to another district requires a new certificate. A press cannot be closed or seized for printing news, articles or other reading material. Publishers must deposit two free copies of each book with the local officer before selling it, and every book must state the publisher, author or editor, printer, press, copyright holder, edition, print run and price. Nepal Law Commission, Government of Nepal Section 2(ta), p. 4; Sections 3–6, pp. 4–6
- Newspapers and periodicals sold publicly must be registered with the local officer. A temporary certificate is issued within 35 days, and a permanent one after the Press Registrar checks that no other periodical has the same name. Periodicals of government offices, universities, organisations, companies and party mouthpieces do not need to register. The Press Registrar keeps records of all periodicals, publishes an annual report on them and advises the government on facilities for the press. Domestic and foreign media must report their representatives, who may receive press-representative certificates. Nepal Law Commission, Government of Nepal Sections 7, 19–20, pp. 6–14
- There is no prior censorship and a periodical's registration cannot be cancelled for what it publishes, except in the cases listed in sections 14 and 15. Section 14 bars publishing material that undermines Nepal's sovereignty and integrity or its security, peace and order. It also bars character assassination, insult or promoting gender-based violence or discrimination, material that stirs hostility between castes, religions, classes, regions or communities, and material that harms public decency and morality. Under section 15 the government may, in the national interest, ban publication of news on a specific subject for a set period or require it to be vetted first. It may also bar imports of foreign publications on similar grounds. Nepal Law Commission, Government of Nepal Sections 12–16, pp. 10–12 (s. 14(ga1) added in 2072)
- The local officer enforces most penalties with fines, for example up to Rs 3,000 for false particulars and up to Rs 5,000 for missing imprint details or importing banned foreign publications, along with confiscation of banned material. Publishing without a registration certificate carries up to Rs 5,000, six months' imprisonment, or both. Publishing restricted or banned material carries the penalty under other law or, if there is none, up to Rs 10,000. Appeals against the local officer go to the designated court within 35 days, and owners of wrongly confiscated publications are entitled to compensation. Nepal Law Commission, Government of Nepal Sections 21–33, pp. 14–17
