What does it do?

  • The Act sets up the National Archives to keep documents of national importance safely and in order, and an advisory committee to guide it. The Archives receives, classifies, preserves, microfilms and digitises records, collects historical documents by gift, purchase or loan, supervises how government offices keep their records, protects records from disasters, and reports every year to the Ministry of Culture, Tourism and Civil Aviation. The 2081 amendment added a schedule listing 'documents of national importance' (for example Lalmohar-sealed documents, Cabinet decisions, treaties, maps and boundary records, commission reports and land-ownership records). Nepal Law Commission Sections 2.1.7–2.1.8, 3–5, pp. 4–7; Schedule, pp. 15–16
  • Government offices (now including those of the federal parliament, provinces and local levels, and public corporations) must send to the National Archives documents of national importance that are 25 years old or more, original historical documents such as copper-plate and stone inscriptions, and copies of first-day postal issues; they may also deposit reports, treaties, maps, files and films, with or without a set access period. Every office must keep its own records in order, name a records focal person and follow the Archives' instructions after inspection; provinces and local levels must also send one copy of documents of national importance and may make their own records laws. Nepal Law Commission Sections 2.1.4, 6–6B, 8, 11A, pp. 3, 7–11, 13
  • Anyone may view non-restricted records and get copies on paying the prescribed fee. Records an office has deposited with access limits, or that the Archives has designated as restricted for national reasons, are 'restricted records'. Private persons may deposit important documents, and the Government may buy or accept them and may seize privately held documents of national importance that are at risk of damage. Taking original documents of national importance out of Nepal needs Cabinet approval. Nepal Law Commission Sections 7–7A, 9–10, 11B, pp. 10–13
  • No one may alter, add to, tear or destroy records. Archives staff who show restricted records to unauthorised people, or who alter or destroy records, face fines of up to Rs 50,000 and/or imprisonment of up to three years (two years for alteration); others who damage records are also fined and/or jailed, and other breaches carry fines of up to Rs 50,000. The Government of Nepal is the plaintiff in cases under the Act. Nepal Law Commission Sections 11–14, pp. 12–14
