What does it do?

  • The Act establishes the Council for Technical Education and Vocational Training (CTEVT) as an autonomous corporate body to organise basic, middle and higher-level technical education and vocational training, coordinate training providers, and set and certify skill standards. A Technical Education and Vocational Training Assembly chaired by the education minister — with planning, public service and ministry officials, the FNCCI president, university technical deans, experts and industry representatives — sets policy, approves the budget and evaluates progress. Nepal Law Commission (lawcommission.gov.np), consolidated official text Preamble; Sections 2क, 3–5क, pp. 1–6
  • The Council, chaired by the education minister with a government-nominated vice-chair, approves and supports private and non-government technical schools and training programmes, runs polytechnics and training centres, develops curricula, organises apprenticeships and instructor training, classifies, tests and certifies skills, and evaluates other bodies' training at national level. It may raise funds from national and international sources and sign agreements with prior government approval. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 3.2, 6, 8, pp. 4–8
  • The Council's accounts are audited by the Auditor General; it reports its budget, progress and audit to the Assembly, and the government may give it directions. Nepal Law Commission (lawcommission.gov.np), consolidated official text Section 6.21, p. 8; Sections 11, 13, p. 9

Gaps, loopholes and improvement ideas

  • Capacity The Auditor General's 63rd report found that enrolment in CTEVT programmes is falling — 29,571 students against capacity of 75,724 in FY 2081/82 (39.05 percent) — that three schools (including Madan Ashrit Technical School) had not submitted FY 2081/82 accounts for audit despite Section 11, and that Rs 68.18 crore received directly from a foreign agency was not audited. Office of the Auditor General, Nepal · Nepal Law Commission (lawcommission.gov.np), consolidated official text OAG 63rd report, Ministry of Education chapter (CTEVT), paras 110.1, 114–115, PDF pp. 493–495 (printed pp. 461–463); Act Section 11, p. 9

Ideas to fix it

  • The Auditor General recommends reviewing the Council's mandate in line with the constitutional lists of powers and their detailed allocation, and having the Council approve minimum standards for opening technical schools and regulate schools against them, since provinces and local governments also run similar schools. Proposed by: Office of the Auditor General (63rd Annual Report) Office of the Auditor General, Nepal

Where does it conflict with other laws?

    The Auditor General notes that technical education and vocational training is not on the federal government's list of powers in the Constitution, yet the Council remains under the federal government, while provinces and local governments also establish and run similar schools. Office of the Auditor General, Nepal OAG 63rd report, CTEVT para 113, PDF p. 494 (printed p. 462)
