What does it do?

  • To control floods, landslides and soil erosion, the Government of Nepal may declare any area a protected watershed by notice in the Nepal Gazette. A watershed conservation officer prepares an integrated watershed management plan (approved by the Department since a 2082 amendment) and may build check dams, embankments, terraces, drainage channels, retaining walls and ponds, set up trial plots and classify land in the area. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 3–5, PDF pp. 2–3
  • In a protected watershed, owners or tenants of designated land must farm or plant using prescribed land-use practices, with technical and financial support available; owners are compensated when conservation works are built on private land. Without the officer's permission, no one may alter streams, dig, quarry or clear vegetation on land marked as flood-, landslide- or erosion-prone, and the government may relocate industries, businesses or settlements, or acquire land, for conservation. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 6–8, PDF pp. 3–4; Sections 10–11, 14, PDF pp. 4–5
  • A National Resource Conservation Commission advises the government and district soil and watershed conservation committees coordinate local work. Damaging conservation structures is punishable by up to one year in prison or a Rs 1,000 fine or both plus recovery of the damage; breaching land-use or hazard-area rules by up to two or three months or Rs 500. The Government of Nepal is the plaintiff. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 15–17, PDF pp. 5–6; Sections 21–22, PDF pp. 6–7
