What does it do?

  • The Act governs building, maintaining and widening public roads. By Gazette notice the government classifies roads (since 2075: national highways, provincial highways, local, rural, urban and agricultural roads, among others) and fixes a right-of-way (road boundary) of up to 31 metres either side of the centre line; where none is fixed, it may ban permanent buildings within 6 metres of the road edge, and the Department of Roads may demolish illegal structures at the owner's cost. Land for roads is acquired under the land acquisition law. Nepal Law Commission, Government of Nepal Sections 3–4, pp. 3–4
  • Road authorities may acquire extra land for road works with compensation (determined with the local ward member, with complaints to the government within 35 days), plant trees beside roads, take soil, stones and sand from nearby land, and remove goods or obstructions blocking traffic. Nepal Law Commission, Government of Nepal Sections 14–21, pp. 5–11; Sections 27–28, p. 13
  • Owners of land within 250 metres of a new road (in 125-metre bands) pay a one-time development tax based on the gain from the road, collected like land revenue if unpaid; the government may reduce or waive it. Damaging road trees, running overweight vehicles, obstructing road works or encroaching on roads carry fines of up to Rs 2,000–5,000 and prison of up to three months to a year. Nepal Law Commission, Government of Nepal Sections 22–26, pp. 11–13; Sections 30–31, pp. 13–15

Gaps, loopholes and improvement ideas

  • Not enforced Rights-of-way are not always fixed. Section 3 lets the government set a road boundary of up to 31 metres either side, with a 6-metre default where none is set, yet on the Pushpalal (Mid-Hill) Highway, being built 11 metres wide with a 7.7-metre carriageway, the right-of-way had still not been determined, and the Auditor General asked that it be set according to road standards before construction. Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 62nd Report, MoPIT chapter (Pushpalal Mid-Hill Highway), para 54, printed p. 374; Act ss. 3–3क, p. 3
