What does it do?

  • This Act has been repealed by Section 78(a) of the Act Amending Some Nepal Acts, 2082 (authenticated 2082-04-14 BS). The points below describe the Act as it stood before repeal. Ministry of Law, Justice and Parliamentary Affairs Section 78(क), PDF p. 62
  • The Act governs 'rakam' contracts: the government may grant a contractor exclusive rights, across Nepal or in a given area, to collect, produce or sell a particular item, or to collect a fee set by the government. Only the Government of Nepal may award such contracts, and no one may act against the rights a contractor gets under one. Contracts must be awarded by inviting tenders or holding an open auction, after public notice at least three months before the contract starts. Ministry of Law, Justice and Parliamentary Affairs (moljpa.gov.np), consolidated text Section 2(क), PDF p. 2; Sections 3–5, PDF pp. 3–4
  • The government may accept or reject any or all tenders or bids, with or without giving reasons, and may re-tender. Bidders offering to pay in a lump sum get a set margin of preference over those paying in instalments, but that preference does not go to a non-Nepali bidder whose offer is equal to or lower than a Nepali citizen's. People convicted of theft, robbery, fraud, forgery or murder-related offences, bankrupts and government debtors may not take contracts. Ministry of Law, Justice and Parliamentary Affairs (moljpa.gov.np), consolidated text Section 9, PDF pp. 6–8; Section 10, PDF p. 8
  • Contracts normally run for three years, though the government may set a different term. If a contractor fails to perform or quits early, the government's loss and dues plus 10% interest are recovered from the deposit, the contractor and the guarantor; the government can waive some of this where the failure was beyond the contractor's control, and must itself compensate the contractor if it breaks the contract. If no contract is in place, the government may run the work directly. Ministry of Law, Justice and Parliamentary Affairs (moljpa.gov.np), consolidated text Section 11(1), PDF p. 8; Section 24, PDF p. 17; Section 27, PDF pp. 17–18
  • Acting against a contractor's exclusive rights, or awarding such a contract without authority, is punishable under any specific law, or otherwise by recovery of the amount involved plus an equal fine (up to Rs 500 if no amount is involved). A person who took a contract as a Nepali citizen but is later shown not to be one loses the benefits given to citizens. Someone involved in theft or concealment in a government contract who confesses before any complaint is spared prosecution under this Act, though the amount can still be recovered. Ministry of Law, Justice and Parliamentary Affairs (moljpa.gov.np), consolidated text Section 26, PDF p. 17; Sections 27क–28, PDF p. 18
