What does it do?
- The Government of Nepal may order land surveys for all or part of the country, carried out by designated survey officials who may set up control points and enter land, after giving owners, tenants, neighbours and local governments at least 15 days' notice. Area is recorded in hectares and square metres (old bigha and ropani records are converted), and ward and municipal boundaries are fixed before surveying. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 3–6, PDF pp. 4–7
- If a survey finds more or less land than in the old record, the new area is registered to the owner; boundaries with government, public or community land are fixed from old records or, failing those, on the recommendation of the ward chair and neighbours and a committee. After surveying, owners receive a land ownership certificate (separately for each floor where floors of a building are owned separately); maps and records are kept in the format set by the Survey Department, and the government may form a committee to correct wrongly registered government, public, community or forest land. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 7–8, PDF pp. 11–12; Sections 11–11ख, PDF p. 14
- Surveys for government purposes are free, but people who request surveys for their own purposes pay the cost; owners and tenants must protect control points and are compensated for land used for them. Obstructing a survey is fined Rs 50 the first time, Rs 50–100 the second and Rs 100–500 the third, or up to six months in prison, or both. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 9–9ख, PDF p. 13; Section 12(1), PDF p. 15
Gaps, loopholes and improvement ideas
- Capacity The Auditor General noted that Nepal's cadastral maps are not yet uniform and that re-survey work has made limited progress. After the Act, the Survey Department completed a one-time survey by 2055; of the then 75 districts, 37 were surveyed using national control points and 38 only on 'free-sheet' maps. A re-survey of the free-sheet districts started in 2052 was not carried out in FY 2080/81 (OAG 62nd report), and the 63rd report repeats the same 37/38 split while noting LiDAR survey work had begun. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 62nd report, Survey Department para 29 (PDF p. 375, printed p. 345); OAG 63rd report, para 38 (PDF p. 338, printed p. 306)
