What does it do?
- This short Act (2019 BS, i.e. 1962 AD) lets senders insure letters, parcels and other items sent by post within Nepal against loss or damage in transit. The government sets by Gazette notice which items can be insured and the insurance fee payable in addition to normal and registered postage; the post office gives the sender a receipt. An item counts as 'in transit' from when it is handed in at a post office until it is delivered to the addressee or returned to the sender.वि.सं. २०१९ को यो छोटो ऐनले नेपालभित्र हुलाकबाट पठाइने चिठी, पार्सल लगायतका वस्तु ओसारपसारका क्रममा हराए वा नोक्सान भए क्षतिपूर्ति पाउने गरी बीमा गर्ने व्यवस्था गर्छ। कुन वस्तुको बीमा गर्न सकिने र साधारण तथा रजिस्ट्री हुलाक टिकटका अतिरिक्त कति बीमा दस्तुर लाग्ने भन्ने सरकारले राजपत्रमा सूचना प्रकाशन गरी तोक्छ; हुलाक कार्यालयले पठाउनेलाई रसिद दिन्छ। हुलाक कार्यालयमा बुझाएको समयदेखि ठेगानावालालाई बुझाएको वा पठाउनेलाई फिर्ता गरेको समयसम्म वस्तु हुलाकमार्फत चलान भइरहेको मानिन्छ। Nepal Law Commission (lawcommission.gov.np), consolidated official text Preamble; Sections 2–4, pp. 1–3
- If an insured item or part of it is lost or damaged in the post, the Government of Nepal is liable to compensate the sender up to the insured amount, subject to prescribed conditions, but never more than the item's actual value.बीमा गरिएको हुलाक वस्तु वा त्यसको कुनै अंश हुलाकबाट चलान हुँदा हराए वा नोक्सान भए तोकिएका सर्तको अधीनमा बीमा गराएको रकमसम्म पठाउनेलाई क्षतिपूर्ति दिने दायित्व नेपाल सरकारको हुन्छ, तर कुनै पनि अवस्थामा वस्तुको वास्तविक मूल्यभन्दा बढी क्षतिपूर्ति दिइँदैन। Nepal Law Commission (lawcommission.gov.np), consolidated official text Section 5, p. 3
- Insured items that cannot be delivered are kept at the post office for a prescribed period and then returned to the sender free of charge; if that also fails they go to the Postal Directorate, which may open them confidentially to find the sender's address. Items still unclaimed are published in the Gazette and held for one year, after which cash is deposited to the government and goods are auctioned with the proceeds going to the government.
