What does it do?

  • The Government of Nepal may acquire any property it considers necessary in the public interest. An officer designated by the government fixes the compensation. A person who disagrees may appeal to the government within 35 days of being told the amount, and the government's decision is final. Where another law already sets how compensation for a property is fixed, that method is followed and payment can still be made under this Act. Nepal Law Commission, Government of Nepal Section 3(1)–(4), pp. 1–2
  • Compensation for property abolished, acquired or to be acquired under any Nepali law may be paid in government 'stock' (bonds) instead of cash, though the government may choose to pay cash. The stock is issued by the government or Nepal Rastra Bank. The government sets the repayment period and interest rate by notice in the Nepal Gazette, up to a ceiling of 20 years and 5 per cent interest, and may pay interest from the date the property was abolished or acquired. Nepal Law Commission, Government of Nepal Sections 4, 5 and 7, p. 2
  • Nepal Rastra Bank pays principal and interest on the government's behalf, may act as trustee of the stock, keeps the register of holders, transfers stock on request for a fee and reports to the government on the stock's financial position. Payments are a charge on the Consolidated Fund, and the government may set up a debt redemption fund. Disputes over who owns stock are decided by the courts. Nepal Law Commission, Government of Nepal Sections 6, 8–13, pp. 2–3
  • The Act also amended the Birta Abolition Act 2016, removing that Act's own compensation method so that Birta compensation is handled under this Act. Nepal Law Commission, Government of Nepal Section 14, p. 3

Gaps, loopholes and improvement ideas

  • Outdated The Act is largely redundant. The High-Level Economic Reform Suggestion Commission found that this Act, which appears linked to compensation for Birta land, overlaps with the Immovable Property Requisition Act 2013 and the Land Acquisition Act 2034, which deal with the same purpose, and that it has been used very little. It described the Act as entirely irrelevant today. High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance Legal reform chapter, item 9, printed pp. 85–86 (PDF pp. 152–153); item 23, printed p. 90 (PDF p. 157)

Ideas to fix it

  • Repeal the Compensation Act 2019, as one of the Acts found to restrict economic freedom, raise business costs unnecessarily, risk misuse or be irrelevant today. Proposed by: High-Level Economic Reform Suggestion Commission (2081) High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance
