How the chair and members are appointed
Appointed by the President on the recommendation of the Constitutional Council (Art. 255(2)); a parliamentary hearing is held before appointment (Art. 292).संवैधानिक परिषद्को सिफारिसमा राष्ट्रपतिबाट नियुक्ति (धारा २५५(२)); नियुक्तिअघि संसदीय सुनुवाइ हुन्छ (धारा २९२)।

What it must do

  • Study the overall situation of the Dalit community, identify the policy, legal and institutional reforms needed, and recommend them to the Government of Nepal.दलित समुदायको समग्र अवस्थाको अध्ययन अनुसन्धान गरी आवश्यक नीतिगत, कानूनी र संस्थागत सुधारका क्षेत्र पहिचान गरी नेपाल सरकारलाई सिफारिस गर्ने। Government of Nepal Art. 256(1)(a), PDF p.149

Its stated goals

What it has delivered

  • 64 complaints of caste discrimination, untouchability and related rights violations were registered and sent to District Administration Offices, District Police Offices and other bodies for action.   • On 2081/08/16 the Commission recommended a definition of the Dalit community and a list of Dalit surnames. The fifth report says this was still unapproved.   • Budget: Rs 4,04,29,430 was allocated (Rs 3,93,04,430 current, Rs 11,25,000 capital). Where it falls short

  • The Commission has only a central office.   • It has no building of its own and rents an office in Kupondole, Lalitpur.   • Programme budget has fluctuated sharply: Rs 34,75,000 in FY 2074/75, Rs 3,63,000 in FY 2078/79 and Rs 27,21,122 in FY 2081/82. How to make it stronger

  • Set up provincial offices, and a Dalit community development authority under the Commission's policy coordination, with the budget, staff and resources the Commission requests.संवैधानिक व्यवस्थाबमोजिम प्रदेश कार्यालय स्थापना गर्ने, आयोगको नीतिगत समन्वयमा रहने दलित समुदाय विकास प्राधिकरण गठन गर्ने र आयोगको मागअनुसार बजेट, जनशक्ति र भौतिक स्रोत उपलब्ध गराउने।

  • Policy Nepal explanation, not a finding: one option is for the Commission's annual report to publish a running count of its recommendations by status (implemented, in progress, not implemented), since it describes implementation only in general terms.पोलिसी नेपालको व्याख्या (निष्कर्ष होइन): आयोगले कार्यान्वयनको अवस्था सामान्य रूपमा मात्र उल्लेख गर्ने भएकाले वार्षिक प्रतिवेदनमा सिफारिसहरूलाई अवस्थाअनुसार (कार्यान्वयन भएका, प्रक्रियामा रहेका, नभएका) गन्ती गरी प्रकाशित गर्नु एउटा विकल्प हुन सक्छ।

Who holds it to account

  • Annual report: the Commission reports each year to the President, who has the report laid before the Federal Parliament through the Prime Minister. Its sixth report (FY 2082/83) was presented to the President, according to a press note dated 2083/06/21.   • Appointment and removal: the Chairperson and members are appointed by the President on the Constitutional Council's recommendation, after a parliamentary hearing, for six years.   • Review of the commission itself: Parliament must review the Part-27 commissions ten years after the Constitution began.
