Nepal Foreign Service Rules, 2068

What does it do?

• These rules, made under the Civil Service Act, 2049, form the Nepal Foreign Service with gazetted first, second and third classes and non-gazetted first and second classes. • Foreign Service staff are transferred only to posts within the service, based on seniority, efficiency and experience. Staff at a mission abroad are normally transferred after four years unless a fixed term was set. The Ministry of Foreign Affairs may depute staff to missions, and staff transferred to a mission may be sent up to seven days early for handover and briefing. When a first-class officer becomes head of mission, a pool post in the Ministry keeps their position.परराष्ट्र सेवाका कर्मचारीलाई सेवाभित्रकै पदमा मात्र जेष्ठता, कार्यक्षमता र अनुभवका आधारमा सरुवा गरिन्छ। अवधि तोकिएकोमा बाहेक नियोगमा कार्यरत कर्मचारीलाई सामान्यतया चार वर्षपछि सरुवा गरिन्छ। परराष्ट्र मन्त्रालयले कर्मचारीलाई नियोगमा काजमा खटाउन सक्छ र नियोगमा सरुवा भएकालाई बरबुझारथ र ब्रिफिङका लागि बढीमा सात दिनअगावै काजमा पठाउन सकिन्छ। राजपत्राङ्कित प्रथम श्रेणीको कर्मचारी नियोग प्रमुख भएमा पदाधिकार कायम राख्न मन्त्रालयमा पूल दरबन्दी सिर्जना हुन्छ। Nepal Law Commission Rules 7(1)-(3), 8(1)-(4) and 9(1)-(6), PDF pp. 2-3
• Staff posted to missions get diplomatic ranks by class and length of service; for example, a gazetted third-class officer with six or more years in that class becomes First Secretary or Consul, and one with less becomes Second Secretary or Consul. Missions work 40 hours a week. • Heads of mission and staff of the Ministry and missions must not marry a foreign national without the government's prior approval. They must follow the Ministry's diplomatic code of conduct, must not act against Nepal's interest or breach the mission's confidentiality, and must learn about the host country before going. A head of mission needs the Ministry's prior approval to leave the host country, and mission staff need the head's approval to leave the city.नियोग प्रमुख तथा मन्त्रालय र नियोगमा कार्यरत कर्मचारीले नेपाल सरकारको पूर्वस्वीकृति नलिई विदेशी नागरिकसँग विवाह गर्न हुँदैन। उनीहरूले परराष्ट्र मन्त्रालयको कूटनीतिक आचारसंहिता पालना गर्नुपर्छ, देशको हित प्रतिकूल काम वा नियोगको गोप्यता भङ्ग गर्न हुँदैन र खटिनुअघि सम्बन्धित देशबारे जानकारी राख्नुपर्छ। नियोग प्रमुखले नियोग रहेको मुलुकबाहिर जान मन्त्रालयको पूर्वस्वीकृति र नियोगका कर्मचारीले सहर छाड्न नियोग प्रमुखको स्वीकृति लिनुपर्छ। Nepal Law Commission Rules 15(1)-(3), 16, 17(1)-(2) and 18, PDF pp. 5-6
• Heads of mission must report as the Ministry requires, and urgent matters at once; at the end of a posting, heads and staff must submit a report on achievements and future work. Allowances abroad are set by the Council of Ministers on the advice of a committee chaired by the Secretary of the Ministry of Foreign Affairs. Missions may hire local staff on contract for approved posts. These conduct and reporting rules also cover heads and staff from outside the service, but several do not apply to local staff.नियोग प्रमुखले मन्त्रालयले तोकेबमोजिम र तुरुन्त जानकारी दिनुपर्ने विषयमा तत्कालै प्रतिवेदन दिनुपर्छ; कार्यकाल सकेर फर्कनुअघि नियोग प्रमुख र कर्मचारीले उपलब्धि र भावी कामसहितको प्रतिवेदन दिनुपर्छ। भत्ता तथा सुविधा परराष्ट्र मन्त्रालयका सचिव संयोजक रहेको समितिको सिफारिसमा मन्त्रिपरिषद्ले तोक्छ। नियोगले स्वीकृत पदमा करारमा स्थानीय कर्मचारी राख्न सक्छ। आचरण र प्रतिवेदनसम्बन्धी यी नियम सेवाबाहिरका नियोग प्रमुख र कर्मचारीलाई पनि लागू हुन्छन्, तर तीमध्ये केही स्थानीय कर्मचारीलाई लागू हुँदैनन्। Nepal Law Commission Rules 19(1)-(2), 20(1)-(2), 21(1)-(2) and 22, PDF pp. 6-7
