Nepal Miscellaneous Services (Constitution, Group and Classification and Appointment) Rules, 2050

What does it do?

• These rules, made under Section 75 of the Civil Service Act, 2049, set up the Nepal Miscellaneous Service. It has gazetted posts in the special, first, second and third classes, non-gazetted posts in the first to fourth classes, and posts with no class. Schedule 1 lists which posts sit in each class, such as chartered accountant, computer engineer, cartographer, women development officer, telephone operator and security guard.निजामती सेवा ऐन, २०४९ को दफा ७५ बमोजिम बनेका यी नियमले नेपाल विविध सेवा गठन गर्छन्। यस सेवामा राजपत्राङ्कित विशिष्ट, प्रथम, द्वितीय र तृतीय श्रेणी, राजपत्र अनङ्कित प्रथमदेखि चतुर्थ श्रेणी तथा श्रेणीविहीन पदहरू रहन्छन्। कुन श्रेणीमा कुन पद रहन्छ भन्ने अनुसूची–१ मा छ, जस्तै चार्टर्ड एकाउन्टेन्ट, कम्प्युटर इन्जिनियर, कार्टोग्राफर, महिला विकास अधिकृत, टेलिफोन अपरेटर र सुरक्षा गार्ड। Nepal Law Commission Preamble and Rules 3-4, PDF pp. 1-2; Schedule 1, PDF pp. 4-9
• Vacant posts are filled as set out in Section 7(1) of the Act. Posts with no class must be filled by open competition when filled by first appointment. Anyone not disqualified under Section 10 of the Act who meets the minimum qualification in Schedule 2 may apply. For example, a gazetted first-class chartered accountant must have passed the chartered accountancy exam from an institution recognised by Tribhuvan University and have 7 years' experience in the field; a second-class one needs 5 years.सेवाका रिक्त पद ऐनको दफा ७(१) बमोजिम पूर्ति हुन्छन्। श्रेणीविहीन पद शुरु नियुक्तिद्वारा पूर्ति गर्दा खुला प्रतियोगिताबाट गरिन्छ। ऐनको दफा १० बमोजिम अयोग्य नभएका र अनुसूची–२ बमोजिमको न्यूनतम योग्यता पुगेका व्यक्ति उम्मेदवार हुन सक्छन्। जस्तै, राजपत्राङ्कित प्रथम श्रेणीको चार्टर्ड एकाउन्टेन्टका लागि त्रिभुवन विश्वविद्यालयबाट मान्यताप्राप्त संस्थाबाट चार्टर्ड एकाउन्टेन्सी परीक्षा उत्तीर्ण गरी सम्बन्धित क्षेत्रमा ७ वर्षको अनुभव र द्वितीय श्रेणीका लागि ५ वर्षको अनुभव चाहिन्छ। Nepal Law Commission Rules 5-6, PDF p. 2; Schedule 2, Part (क) items 1-2, PDF p. 10
• For most other posts the minimum qualifications are not written in the rules. Government of Nepal sets them from time to time after consulting the Public Service Commission (for gazetted third-class and non-gazetted posts), or on its own (for posts with no class). To be promoted through work-performance evaluation, a gazetted employee needs the education required by Section 24घ(3) of the Act, and a non-gazetted employee needs the education required to enter that post. • Employees of the service may be transferred only to posts within the same service, following Chapter 6 of the Civil Service Regulation, 2050. The Ministry of General Administration runs and administers the service. Government of Nepal may change the schedules by notice in the Nepal Gazette. The rules repealed the Nepal Miscellaneous Service (Constitution) Rules, 2016.यस सेवाका कर्मचारीलाई निजामती सेवा नियमावली, २०५० को परिच्छेद ६ को अधीनमा रही सेवाभित्रकै पदमा मात्र सरुवा गरिन्छ। सेवाको सञ्चालन र प्रशासन सामान्य प्रशासन मन्त्रालयले गर्छ। नेपाल सरकारले नेपाल राजपत्रमा सूचना प्रकाशित गरी अनुसूचीमा हेरफेर वा थपघट गर्न सक्छ। यी नियमले नेपाल विविध सेवा (गठन) नियम, २०१६ खारेज गरेका छन्। Nepal Law Commission Rules 2(ख), 8-11, PDF pp. 1, 3
